In a webinar on Aug. 3 with the Oklahoma Farm Bureau, an agriculture business group, Stitt made clear the magnitude and impact of the Supreme Court’s McGirt v. Oklahoma decision on the running of the state, noting that it affected, “…taxes, regulations and criminal cases.” In a telling exchange, Farm Bureau President Rodd Moesel and Stitt agreed federal legislative intervention was necessary, citing a hint from the author of the McGirt decision, Justice Neil Gorsuch:

Moesel: It sounds like the only solution is congressional action now. Gorsuch says in his decision that Congress has the power to end it or make other arrangements just as they have done with the Chickasaw Nation… Stitt: …I don't [see any other solution]. It would just be compact after compact after compact. We have great relations and the state works well with tribes today, but the uncertainty is who will the chiefs of the tribes be 5 or 10 years from now, who is the next governor, what do the compacts look like, and the state has apparently little say in what goes into these compacts and how to audit them. The federal delegation going in and fixing this is what the attorneys are telling us.

A Tale of Two Police Shootings: A Black victim sparked protests, a dead Native man got ignored

Many of the most recent Native victims to police gun violence have centered in the midwest — from Wisconsin to the Dakotas. The list of victims is long and largely overlooked. In 2017, at least 31 Indigenous people died during an interaction with law enforcement. In 2016, there were 29 fatalities reported. Here are a few of them, including some recent cases:

On April 14, 2019, Clarence Leading Fighter (Santee Sioux), 32, left behind a seven-year-old son the morning a Nebraska State Patrol deputy shot him in the back while attending Palm Sunday mass in the town of Rushville. Deputies said they were attempting to apprehend him in connection with an alleged assault that had taken place hours earlier. In August, a grand jury determined no officer would be charged with a crime.

Jonathon Tubby, a 26-year-old member of the Oneida Nation, ran a stop sign in downtown Green Bay, Oct. 19, 2018. Police discovered he was wanted for failure to serve a jail sentence. Hours after the arrest, Tubby, still in handcuffs, lay dead in the jail’s “sally-port,” shot five times by officer Erik O’Brien who said he believed Tubby had a gun. The city denied any wrongdoing. His family has filed a civil suit against Officer O’Brien.

On Nov. 14, 2017, fourteen-year-old Jason Pero was gunned down on his homelands on the Bad River reservation in northern Wisconsin by a border town police officer. Ashland County Sheriff’s Deputy Brock Mrdjenovich fatally shot Jason after responding to the teen’s own 9–1–1 call. Mrdjenovich claimed Jason had lunged at him with a knife and that he feared for his life. No charges were ever filed.

The family of George “Ryan” Gipp, Jr. of Standing Rock says the two BIA officers that tased and fatally shot him were unjustified actions and are now seeking damages. In Oct. 2017, Gipp was gunned down on the Standing Rock reservation in the community of Fort Yates, ND. After an FBI review, the U.S. attorney’s office in North Dakota determined that criminal charges against the officers were unwarranted.

On March 27, 2016, Loreal Tsingine, (Navajo), 27, was walking the streets of Winslow, AZ when she was fatally shot by officer Austin Shipley. Police bodycam footage shows Shipley push Tsingine to the ground twice before she got up and walked to her death. She showed no signs of wielding a weapon despite the officer’s claims. In May 2019, a federal court dismissed the Navajo Nation’s lawsuit seeking justice.

Mi’kmaw treaty rights, reconciliation and the ‘rule of law’
Mi’kmaw peoples continue to pay a heavy price for the failure of Canada to uphold the rule of law

On September 17, 1999, the Supreme Court of Canada (SCC) issued its decision in the R. v. Marshall case, confirming that the treaties of 1760-61 protect the Mi’kmaw right to hunt, fish, gather and engage in commercial trade. Yet, 21 years later and successive federal and provincial governments in Mi’kma’ki (Atlantic Canada) have failed to fully respect or implement the right of Mi’kmaw peoples to earn a livelihood from our own lands and waters. To make matters worse, when Mi’kmaw at Sipekne’katik (formerly Indian Brook First Nation) develop their own governance plan for their fisheries, they are met with racism, threats, violence and destruction of their fishing gear. Where is the so-called ‘rule of law’ when Mi’kmaw rights and lives are at risk?

Well, the short answer is that the rule of law is MIA. Non-native commercial fisherman, many of them identifying as Acadians, have openly threatened and harassed Mi’kmaw peoples at Saulnierville wharf in southern Nova Scotia in front of the RCMP. They have also gathered their fishing boats in large numbers to chase the much smaller Mi’kmaw boats, shoot flares at them and by Mi’kmaw accounts, try to ram their boats—all while the federal Department of Fisheries and Oceans (DFO) and the Coast Guard look on. These same non-native fishermen have also hauled Mi’kmaw lobster traps out of the water, cut their lines or damaged them. Again, law enforcement has done little to protect Mi’kmaw peoples or property.

In the Colten Boushie case in Saskatchewan, Gerald Stanley, a white farmer, shot and killed Boushie in the name of defending “his” property. He was found not-guilty for taking Boushie’s life. Farmers then rallied around Stanley, threatening to take the law into their hands—with lethal force if necessary—to protect property. In Winnipeg, a 16-year-old girl, Eisha Hudson, was shot and killed by Winnipeg Police over an alleged theft at a liquor store—this time to protect a few stolen bottles of booze. If you are starting to a see a pattern, then join the club. The lives of Indigenous peoples have long been considered both exploitable and expendable in the name of private property.

Back in Mi’kma’ki, the racism of many commercial fishermen that is usually well hidden behind their massive fishing boats, fancy trucks and large houses funded by the billion dollar fishing industry on Mi’kmaw waters, is on display for the whole world to see. What this spectacle of racialized violence shows is that the ‘rule of law’ is a fiction and always has been. These fishermen have been able to engage in crimes of violence and property destruction with apparent impunity, even flaunting the removal of Mi’kmaw lobster traps in the media. They have been able to violate many laws, rules and regulations in relation to how they operate their boats on the water by putting Mi’kmaw lives at risk—again with impunity. Yet, we all know that had Mi’kmaw peoples engaged in any of these violent or criminal acts, there would have been swift arrests and confiscation of our gear. That’s not the rule of law. That’s the law of rulers.

Nova Scotia RCMP are under fire for failing to stop an angry mob from attacking two rural storage facilities holding Mi’kmaq lobster, throwing rocks, setting a van ablaze and restraining fishermen in one of the most violent confrontations yet in a dispute over the fishery.

RCMP say a group of around 200 people blocked employees from leaving a lobster storage facility in Middle West Pubnico on Tuesday night, five hours after a similar-sized crowd surrounded workers at a facility in New Edinburgh, N.S., about a 110 kilometres north. In both cases, police were on the scene as the mob pelted vehicles and the buildings with rocks.

In Middle West Pubnico, two Mi’kmaq fishermen say they were followed and barricaded inside by the mob, threatened and saw thousands of pounds of Indigenous-caught lobster destroyed after the group ransacked the building. One of the fishermen, Jason Marr, said the crowd slashed his tires, vandalized his truck and threatened to burn the building down with him inside.

Police lay arson charges in truck fire following a mob attack on Mi’kmaq fishers

Nova Scotia RCMP say they have laid arson charges in connection with a vehicle fire that happened on Oct. 13 outside a lobster pound in New Edinburgh.

Police say they responded to a “disturbance” and when they arrived at the scene, officers dealt with a vehicle that was “on fire and heavily damaged.”

At the time, a lobster pound in Middle West Pubnico, N.S., was being used by Mi’kmaq fishers.

On Oct. 13, the facility was swarmed, vandalized and ransacked by a large crowd of non-Indigenous commercial fishers and their supporters.

Mi’kmaw fisher Jason Marr told Global News earlier this week that he and others were forced to take cover inside the lobster pound as the building’s windows were smashed out and Marr’s vehicle was damaged, he said.

Jonathan LeBlanc, a member of the Eel Brook Fire Department, told Global News that several local fire departments were called to the scene around midnight. It took over four hours to contain the fire, with crews later turning to a cleanup mode.

Reached overnight, Nova Scotia RCMP said they were unaware of the incident. Yarmouth County RCMP said in a statement Saturday morning that the fire is considered “suspicious” and an investigation is ongoing.
