I listened to a conversation between Charlie Sykes and Bill Kristol on how the GOP is painting itself into a strange corner on some of this stuff. Take for instance DACA or gay rights. Few conservatives actually want to expel the dreamers from the US, or discriminate against gays. A party of grownups, would therefore legislate on both issues. e.g. finally reach a bi-partisan position on immigration reform. Or legislate for how gay rights fit with religious beliefs. But for some reason the GOP can do neither thing. Instead the Trump admin brings increasingly insane cases to the SC to the point where anyone would think it is conservative policy to oppress gays, expel the dreamers, and strip everyone of their healthcare during a pandemic. But these are extreme positions that most conservatives actually do not support. So somehow it looks like Trumpism inhabits some strange world that even conservative justices can't support

I heard a rumor that Thomas was going to retire soon. If Trump loses look for him to retire in Nov-Dec.
Yes, Garland should be, but I think Gorsuch is fine - he's one of the few that has prior experience in both Indian Law and the other typical judicial cases seen in the Western US
Indeed, it was hard to see any meaningful difference from the 9-0 decision on the Nixon tapes-- which involved the President actually Presidentin' in private in near contemporary time. If there was no separation of powers issue there, it is a bit hard to see how there could be any over old tax returns...

Put Garland on and Gorsuch in Kavanaugh's place, and I'd think the court was in pretty good shape despite Alito and Thomas. The first half of the 19th century there were some really serious drop cases on it at times.

If Thomas retires and they rush through a replacement, ESPECIALLY if the Dems get to 50 seats, the pressure on the Dems to add 2 seats will be enormous. And they should do it. The Dems have got to show the GOPs that it's not heads I win, tails we do the coin flip again.

I’m pretty sure RBG is announcing her retirement almost immediately after a Dem is elected to the Presidency. With all the health issues she’s been having recently, I don’t see her sticking around, tbh.
I absolutely expect any conservative justice over 65 to retire before January 20, 2021 at noon. And I fully expect the Senate to vote for replacement justices before January 20, 2021 at noon.
