Joe Biden needs to make an announcement: "The fact the SCOTUS has decided to hear this case is clearly an attempt to keep Trump from facing justice. The only reason they have for taking the case is because there is a majority that believes the idea the President has total immunity has merit. So be it. If that is their ruling, I have the Seal Team 6 order ready. They are all dead justices walking."
Correction:....there is a plurality that believes the idea.... Only need 4 votes to take a case. And I don't think we know how many votes are ever taken for cert on any case. Just at least 4.

Started listening to Weissmann's update on all this but I can tell from his tone that I need to be in the right headspace for it. I've noted before that it is hugely depressing for anyone who has dedicated their life to the law to have to deal with this absurd level of corruption and bad faith from the highest court in the land - especially after what happened on Mueller. I remember in the olden days back in the 90s when one would read analysis of controversial decisions and epic law review articles about how they should be challenged etc - but this is all not that. What's coming out of the SC is hot garbage. I had though they might delay a bit before dismissing this, but now I think they actually might blow the case up.
The Weissmann news is worse than I was expecting Basically both Judge Chutkin and the Appeals Court found that former POTUS never has criminal immunity for his acts. So it was unnecessary for the court to consider whether Trump could have been acting within his official duties for any of his alleged coup acts The Supreme Court has allowed appeal arguments on this exact question. Why this is bad, is basically they could rule that the president can be immune if he was exercising his official duties, then send it back to Chutkin to consider on that basis. She would then find he wasn't acting in his duties, then Trump could appeal it all over again. Obviously the SC should not open up this door, but if they do, it could lead to another new appeal loop. In short, it feels like they either killed the case, or Jack Smith will have to stream line his case to fit in a compressed time frame. When you remember that Chutkin stayed this case way back in December, and that it may now not even go to trial before the election ... go figure. I do think Chutkin should say she doesn't care if there will be an election midstream and just hold the trial anyway - you don't get time off your crime trial for campaigning. But yeah - sad day really.

I was discussing this with a friend as regards the rising german fascism and we both had the view that it is actually better for the state to act with decisive force early - even if putting civil rights questions into play - because if you wait until the fascists have too much power, they will pervert the legal system for the fascist cause. Joe will look awfully stupid when he gets voted out, then Trump ends democracy. Should have used power when he had it.
