I'm not sure why they'd want to but I thought teams could buy a duse who didn't pass a physical if they wanted to assuming both teams could still agree on a fee.

I think it's usually a question of financials. Clubs (at least in Germany I know of) use insurances to protect themselves against injured players, i.e. after some time of injury salary is no longer paid by the club but by the insurance. But insurances won't be willing to cover players that can't pass medicals to begin with.

If that's true then why isn't he suing fenerbahce? Fabian had a couple good seasons in Germany, one would think that at least a couple of Bundesliga clubs would be interested in get him in on loan...
