Sorry, but you are speaking out of your ass. Do not fall for the Libertarian "Property Rights Over All" mantra. It is not true. It has never been true. Libertarianism would quickly expand the inequalities in the world and exploit the weaknesses in the world. As a philosophy of greed and non-caring (in the name of "liberty and freedom"), Libertarianism is what it is. As a workable political concept, it would leave tens of millions (probably, hundreds of millions) of people in this nation suffering. Almost by definition...right up there with the Rule Against Perpetuities [shudders, takes a swig of PTSD meds]. Still, I always like the phrase "open and notorious"...still suspect it could justify a cape and cowl rental for court appearances, as a litigation expense.
I don't bother teaching the Rule Against Perpetuities to my students. A quick mention and move on. Same with fee simple defeasables. 15 minutes, a couple of examples and that's that. Just ugly stuff.
