So, technically, can the guy who was "hired" be accused of rape? Well, I would think that when it comes to violent role playing fantasies, a simple direct question, 'Are you cool with this?' before the role playing begins, wouldn't ruin the fantasy at all, and it could save a lot of trouble if it turns out not to be a mutual fantasy, as this particular case proves. My guess is the guy was in on the rape, but come on, even if he wasn't, if you're in the violent fantasy business you should know better than to not make sure everybody's in on it. If I was in the jury, I wouldn't give him the benefit of the doubt at all on this.
sure, but I was talking technically (or legally, which we all know is completely different from right or wrong), like could he even be charged for it to get to a jury, or would it be a 2nd degree sexual assault or something else instead of rape. Once a rape charge gets to a jury I would not expect any delay in the Guilty verdict. Just curious as it is an odd wording of what seems to have happened.
