I’ve not seen anything suggesting that it’s not- I mean, let’s just say the top three teams are all American teams from MLS (lol- I get it, that will never happen but still…) and none qualify by other means. Do they just get three extra spots?
The CCL is expanding in 2023. There are a whole bunch more spots. 20 teams from the U.S., Canada, and Mexico are going to be qualifying. These 3 Leagues Cup spots are a relatively small portion.

Yes, they apparently have backed off the plan of having a big regionalized group stage. Now it's back to all knockout, with 5 teams directly in the round of 16 and 22 others playing a preliminary round.
There's quite a lot to like there really. I'd be interested to know more about the new cups for Central America and the Caribbean. Getting more best-against-best competition in within those regions is a great idea.

Yeah I think the smaller Central American club teams definitely got the shaft here; with the old (current) format there was at least one or two higher seeded teams from smaller countries that had a better shot of qualifying to the actual CCL, but with this new format I just feel like they're going to be steamrolled by the bigger clubs in Costa Rica, Honduras and to some extent Panama.
They should definitely randomize rather than seed the draw in order to grease the skids a bit for non MLS/MX teams to get deeper into the tournament. The MLS vs Liga MX games are basically equally valuable no matter where they fall in the tournament structure anyway, you aren't losing anything.
