The only way that even remotely makes sense is if it only applies if you know the person is driving and you continue the textversation with them... I'm not sure how you could legally be liable if you don't know they are driving and tweet them. Another question, does this ruling open up the cellphone companies to be liable? After all, they can tell when you are moving, so does them actually delivering the text while knowing that you're in a moving vehicle make them liable?
If they could tell you weren't a passenger, they should block the texts Can they use ultra-fine-GPS settings to see if you're in the driver seat?
I think the story specifies that you can only be held liable if it can be proven that you knew the other person was driving. but hell, isn't it the duty of the person driving to pull over and have the text conversation? I mean suppose I'm texting someone about something that's really important and time sensitive. do I really need to wait until that person is done driving? is it not up to the driver to pull over?
I believe I made very similar in an old thread called drinking and driving hypocrisy essentially arguing that there are other behaviors, such as texting while driving or drowsy driving which are just as, if not as dangerous as driving under the influence (it's not always alcohol. it could just be a medication prescribed to you), yet don't have the same social stigma or legal consequences as drinking and driving. but perhaps it's changing.
Even trickier if the vehicle contains more than one person. The moral of this story is going to become, "If you must text and drive, have a passenger on board so you can hand them the phone and say you were relaying verbal messages to him/her and s/he was the one doing the physical work of texting. Kinda like rock bands used to say before the last tune, "Don't drink and drive. But if you must drink and drive, please drive someone else's car..."
What if the NSA is on the other end monitoring your texts while you're driving? Can they be held liable?
No. If the story is important, make a thread about the story with a descriptive title. I am declaring war on catch-all threads.
A more effective declaration of war would've been the traditional posting of cat pictures, or Sleater Kinney pics. Or both...
I made a joke in the surveillance thread by posting one of those "@ + Screen name" things to the NSA. Imagine my surprise when it actually showed up and reminded me that there is a long time member with that screen name. Which makes me wonder how long this spying thing has been going on.

I was trying to capture as much of it as I could. but I think at this point, the whole "texting while _______" thing has been overcome by the "taking a selfie while ________" - and causing one's own or another's death or injury. but we have a different thread for that...
