    Former President Barack Obama said that “snappy” slogans such as “defund the police” can alienate people, making the statements less effective than intended, Axios reports.

    Said Obama: “You lost a big audience the minute you say it, which makes it a lot less likely that you’re actually going to get the changes you want done.”

    To piss on the parade:

    If Trump is worried about the power of preemptive pardons, then Bill Barr is helping by getting indictments ASAP. If Rudy is indicted, he can get pardoned.

    Any interpretation that suggests Barr is not wholly working to further Trump’s mafia is implausible.

    Since when has a thing like “indictments” been necessary for a pardon? Nixon wasn’t charged when he got his pardon and Trump just gave Flynn a blanket pardon for all crimes he committed during the transition, including crimes the DoJ wasn’t aware of. I’d imagine Trump will do something similar here with his associates.

    My legal expert told me that it is her understanding that a person can’t be pardoned from crimes that have not been completed.

    Not only is He thinking of a pardon for Rudy? He’s thinking of pre emptive pardons for his hell spawn.
    Then now the JD is looking into a Pay-For -Pardon scheme.


    (CNN)The Justice Department is investigating a potential crime related to funneling money to the White House or related political committee in exchange for a presidential pardon, according to court records unsealed Tuesday in federal court.

    The case is the latest legal twist in the waning days of President Donald Trump's administration after several of his top advisers have been convicted of federal criminal charges and as the possibility rises of Trump giving pardons to those who've been loyal to him.
    The disclosure is in 20 pages of partially redacted documents made public by the DC District Court on Tuesday afternoon. The records show Chief Judge Beryl Howell's review in August of a request from prosecutors to access documents obtained in a search as part of a bribery-for-pardon investigation.

    Traditionally, they aren’t necessarily wrong? But we are also in an era where the Supreme Court is dominated by disciples of the unitary executive and we have the “precedent” of Nixon’s pardon and, now, Flynn’s pardon that absolved him from not only the crimes he was indicted for, but any he wasn’t indicted for as well. We also haven’t had a case that sets a limit of a President’s pardon power. In part that’s because we’ve had President’s that believe there is a limit to their power and Trump doesn’t believe there are limits.

    No and no. But it’s a pardon given without an indictment, the court hasn’t set a limit on a President’s pardon power, and SCOTUS is currently dominated by people that believe the President’s power over the executive is absolute.

    is there any way to challenge the constitutionality of a self pardon beyond indicting him, having him assert that he can’t be tried because of the pardon...then follow the appeals process? Is there a way for the DOJ to challenge the constitutionality without that?

    Marcy Wheeler thinks Flynn still has big exposures

    Especially since Flynn can no longer plead the 5th, now is the time to get him into Congress to clear the record. Of course he will lie and commit the same crime again.

    Good question? I wonder if the Judge in Flynn’s case might challenge his pardon. But I’m not sure of the answer otherwise.

    This is what Marcy Wheeler is hoping that the Flynn Judge does.

    Not so much challenging the pardon (it will have to be accepted) but seeking specifics as the prosecution winds down, in order to trap these guys.

    She reasonably suspects that the Barr DOJ is involved in a corrupt abuse of power - so one can lay the groundwork to nail these scumbags in due course

    Does the judge have to accept the pardon? I’ve seen some speculation that the blanket nature of the pardon could be used to invalidate the entire pardon because it may make it so Trump is pardoning a co-conspirator.
