So Pence fought the J6 congressional subpoena on grounds of executive privilege. Now he’s fighting the special counsel’s subpoena, on the very same subject matter, on the grounds that on J6 he was acting as a part of the legislative branch and is therefore protected under the speech and debate clause. The first argument was merit less but neither congress nor the DOJ did anything about it. I must admit…the second argument has merit. Certainly enough merit that it will be appealed to SCOTUS however a lower court judge rules. And I have no doubt this SCOTUS will rule in his favor. Maybe…just maybe…slow rolling the J6 hearings wasn’t the best approach. And if I understand all the Garland DOJ defenders correctly…Merrick and the DOJ are ten steps ahead playing multidimensional chess while every else plays checkers…so perhaps DOJ anticipated this and has a pre planned strategy. My concern is DOJ anticipated this…and this is exactly where they planned to end up…at the end of this road. Too cynical?
It's fair to be cynical based on the horrific events of that day. The outrage was still fresh in 2021 so I wanted quick frogmarchings and trials. Guess all we can do is hope that Merrick is the mild-mannered shopkeeper in public but is really squeezing Trumper balls behind the scenes.
