If the case did go all the way to trial, would it be a jury trial for a jury to decide and to decide amount of any damages? Or would a judge decide?
If you two want to join me in my Pit of Despair, we can get drunk and cry about the state of the world. But here on BS: Everything is awesome! [emoji304][emoji882][emoji322][emoji3590]
He was fired. This is how these things typically go down. It's rare that a club will announce they've fired a FO member unless it's an extreme situation like Petke. If Waibel were truly leaving voluntarily, he would have waited until end of season.
carroll is chief business operator zarkos is vp of soccer operations They both can leave for all I care
I missed this article on friday but apparently, the MLS constitution states that the commissioner is the designated arbiter for contract disputes. It's not clear that players or coaches, who are ostensibly bound by the constitution, even know of its existence, let alone are provided access to it. This is so stupid.
Looks like Petke’s team amended the suit to included ML and Don Garber. I don’t have a ln Athletic subscription, but Turner usually provides some good evaluations of legal proceedings. News: Attorneys for Mike Petke have amended the breach of contract complaint, and have added @thesoccerdon and @MLS to the lawsuit. #RSL #MLS #MLSCupPlayoffs pic.twitter.com/AWUmECwZPq— Miki Turner (@turneresq) October 22, 2019
@soundermiki is great. He's also the author of that Athletic article, which is mentioned in the amended complaint from Petke.
I had thought the original complaint mentioned Carroll. It was Zarkos. I have a hard time believing that, if things are as bad as the complaint makes it sound, that Carroll wouldn't be part of the coup.
I just got back to town and am catching up. So, nothing new on this for almost 3 weeks? That’s a good thing.
Arbitration time. https://www.rslsoapbox.com/2019/11/21/20976671/petke-vs-real-salt-lake-arbitration-judge-rules Looks like a win for DLH.
So basically an arbitrator will decide an amount somewhere between what DLH was offering and what Petke was demanding? Or does the arbitrator choose one side's amount?
If that's consensus, then sure. I just figured there's a resolution coming sometime soon (or maybe it isn't soon so we should just move on?).
Did the arbitrator make their ruling? I can't remember. But either way, Petke is gone and not coming back. This thread probably doesn't need to be pinned anymore.
This just in: Petke, RSL, and MLS, have agreed to settle and dismiss the case. And thus ends the long and sordid case of Petke's Temper. Now if only we knew the details of the settlement... https://www.sltrib.com/sports/rsl/2020/04/21/former-rsl-coach-mike/
Not enough money to pay current employees Enough to settle with past employees and avoid the lawsuit dragging on What a joke this ownership and top end management is
I thought of this on Monday, and was amused that as a fired coach he (and others who were let go last season) might get paid more consistently during the Coronavirus closures than people who are under contract right now.
