Not quite yet. Bar exam in a week and a half. I'm spending 12 hours per day at the library - but then wasting my time posting on here . And then I'm gonna be a federal government bureaucrat .
Tis quite alright. I actually succeed at repping someone maybe 1/10 times I try. That's the problem of only leaving the forum every now and then!
Good luck on the exam. Brush up on some International law if you can from now on so we can have someone for our Forum Lawyer, just not as cocky hopefully.

That's true. But........ This with a FIFA tribunal, which is a private entity. It is not subject to procedural issues, and is therefore, at best a type of "court of equity". I don't know the exact legal relationship between FIFA and ManUtd, but I would assume that ManUtd has foregone means to pursue legal redress in disputes that have FIFA "jurisdiction", so to speak. The reason I brought up Bosman*, previously, is that a case of some sort could in theory be made to an EU court. I'm just not sure on what basis it would be, since, EU doesn't hear contract disputes. Its very likely that the contract Mikel signed has a choice of law clause. (Almost certain, actually.) Chances are, its under English law which probably gives rise to an action there, although for an argument that the contract is invalid in the first place, you might be able to use Norwegian law. I don't know European conflicts of law issues. So with that said, given that its a FIFA ruling, and they aren't bound by English law at all. Whether or not they will find any duress is up to them. I don't know if there was any, I just know one can certainly make a case for it. On the issue of unconscionability in the US, by the way, I don't believe its as clear cut as you make it out to be, haven. A court can still find a contract unconscionable if there was a great disparity in bargaining position despite general fairness. A contract with a 7 year old kid won't necessarily be enforced because he sold his house for market value. Oh, and don't study too hard for the bar. Its not that difficult of an exam. Especially Texas. *Bosman - that ruling is a difficult one to cite to because it still remains one of the most far reaching rulings ever by the EU courts, as far as I know. (Its been a year and a half since I've really looked at EU law.) Whether they will make rulings in a similar vein is unkown, especially against other private entities.

i've missed alot of news about this tug-of-war for mikel... so the problem will remain unresolved till FIFA gives their verdict?
Yeah there really hasn't been much in the way of news recently. Everyone is just waiting for FIFA to rule based on whatever info they have.
if they decide Obi Mikel can leave.. that is a crime. he is your player hands down. come on jack, knock this in damnit!!
