John Wolyniek (sp?) gets a fine and 2 game suspension for hit chad during a corner with an elbow.... john is not a star.

Here's the report from MLS Confidential. Too bad disciplinary action doesn't go into effect immediately. Ruiz is up to his old tricks.
1. FISH UNDER MICROSCOPE: The play from this weekend's action likely to earn the most discussion from the MLS Disciplinary committee is one involving Los Angeles forward Carlos "Little Fish" Ruiz and Kansas City defender Carey Talley.
Talley left in the 80th minute of the Wizards' 2-1 loss in Los Angeles after Ruiz elbowed him in the face while the two jumped for a head ball. Talley was initially diagnosed as a broken left orbital bone (eye socket), and was slated for a CAT scan on Tuesday to determine if surgery is necessary.
"It's brutal, it's flagrant and it looks premeditated," Kansas City Coach Bob Gansler said after watching the play several times on video. "[Ruiz] is a gifted player, but his behavior on the field is reprehensible. This isn't the first time. ... The punishment should fit the crime."
The disciplinary committee only reviews plays that were not seen by the referee during the game or that are deemed "egregious." A recent example was MetroStars forward John Wolyniec's elbowing of Columbus defender Chad McCarty, which was away from the ball and went unseen by the referee, but earned a two-game suspension and a $500 fine. D.C. United's Dema Kovalenko, meanwhile, received a one-game suspension and a $1,000 fine for his late challenge that resulted in a broken leg for Dallas' Ronnie O'Brien. That play was seen by the official and no foul was called, but the committee deemed the play egregious, in part, because of O'Brien's injury.
On Saturday, Ruiz was called for a foul, but was not issued a card for the collision with Talley, who headed the ball. Ruiz had received a yellow card for diving in the 64th minute.

Maybe they will actually do something about this situation.

"I saw (Talley) go down, but I didn't see the elbow," Wizards coach Bob Gansler said. "But on the replay, the elbow was vicious, and it was blatant."

Ruiz was not disciplined during the game for the play, but since the Wizards do think Ruiz threw the elbow on purpose, they want to see Major League Soccer take action.

"I won a header against Ruiz just before that," Talley said. "I think the next one he was going to win no matter what.

"I think (Ruiz) is the best forward in the league, hands down. On this play, yes, I think it was intentional."

"It's a situation where Ruiz should be out as long as Carey Talley -- four games," Wizards general manager Curt Johnson said.

The incident occurred in the 78th minute when Talley and Ruiz both went for a ball in the air.

"I looked up and saw four people coming at me and it was one person," Talley said. "I knew something was wrong when I had triple vision."

I think the only thing that would be unfair in a four-game suspension is that Kovalenko got a one-game suspension. It's unfair to the Dallas Burn organization and it's unfair to Ronnie O'Brien. Either way, I cannot comment on whether or not the play was even intentional as I have not seen it, but the most likely result (if there is a fine and suspension) is a one match ban with a five hundred dollar fine.

Kovalenko was trying to block a cross, he didn't even hit O'Brien, he landed on his leg on a follow through. Reckless by Kovalenko, but not an intentional elbow or anything like it.

Wolyniec _is_ the correct precedent here.

Is it? Wolyniec didnt break any bones, but then again Wolyniec's was away from the ball correct?

I think its hard to have a precendent because each situation is different. Past situations can be guides, but I dont think these fouls can fall into black and white piles. I tend to agree with what Curt Johnson said. By all medical accounts Talley will be out at least 4 Wizards games. For an intentional foul like this have Ruiz set the same amount of time.

Fish is playing for Guatamala this weekend so he won't be in NY anyway. Go ahead and give him what Kovalenko got if you have to. I still think it's BS as he didn't do any more than Talley was doing. His elbow just happened to catch him in the wrong spot. could have just as easily gone the other way.

I can definitely see MLS using this to their "advantage". I can see it now...

Carlos "Little Fish" Ruiz suspended for one MLS game. Oh....look....he happens to be out of town this week for national team duty, we guess that counts as his suspended game. You're even up with us Carlos, go ahead and play next weekend. Nevermind that Talley has a broken face, you're our star and we can't have you setting too long even if you did smash a guys face in.....

I really won't be surprised if thats the case. KC sure can cry foul if this does happen.
