    What difference does three days make? Nothing will happen between now and the certification either way. The only thing that changes is if Jack is "retired" from sight come January or not.

    In light of facts on the ground, I've decided to wind down my posting on this forum, but wanted to mention a very sad interview with Ben Wittes (Tim Miller's Bulwark this weekend).

    Paraphrasing - he's devoted a significant part of his career to a constitutional order that was revealed to be a mirage. Wittes notes that the US rule of law spectacularly failed to hold trump to account. And for some reason voters just don't even care.

    I guess historians will see the broad sweep of events more clearly. But a key moment that stands out in hindsight was the pure corruption of Bill Barr.

    Especially i've said before that I don't think you can stop a constitutional breakdown through purely constitutional means - the breach already happened and the institutions already failed. IMO the defining failure of Biden's administration is a lack of appreciation of the moment, and imagination to face that challenge.

    I wish it was different but we have to get real now.

    Yeah, a slow motion coup that started decades ago. Wingnut judges, watering down the vote of POC with gerrymandering, sliming "the Left" as enemies of America through RW media. As a dastardly anti democratic plan it has worked out spectacularly well for them. Dubya was the first president that was their empty vessel. But Donnie really got them over the finish line with SC justices and challenging the entire voting process.

    We saw this coming 20 years ago. I remember very well the debates around novel legal ideas like unitary executive theory during the Bush presidency. Mirage is right. But don't let anyone tell you this realization wasn't a long time coming.

    Sure. After all Wittes was the guy who thought Barr would be a positive as AG in the Trump chaos. But i do get it. When you’ve dedicated a career to things legal it has to be a heartbreaker. I really feel for Weismann and McCord and the Strict Scrutiny guys as well. you start off imagining you will work on important issues of principle and end up watching the most debased corruption.

    This isn't the time to bail out. Granted this is a low point, and @Knave may be right...we're doomed.

    But I really don't think so.

    Rest up, lick your wounds, do your self care, whatever it takes, but who's really ready to roll over and capitulate? Not me.
