So this Fall tournament will take place even though NISA is unsanctioned by the USSF ? Do they get provisional sanctioning to run this ?

Don't paint all the teams with the same brush. Only 6 or 7 of them are vaporate. Capo FC have been around for nearly 20 years and are trying to inch into pro soccer.
You can't really take NISA seriously. If MLS could use it's resources to help clubs take the first steps into full time professional soccer, particularly in under-served areas, I think it would be good for the game in general. If the teams can subsequently attract investment to pay a USL expansion that's good too.
MLS has already intentionally gone after two USL markets, Chattanooga and Jacksonville, which turns that under-served idea on its head.
Chattanooga FC wanted out of NISA but the Red Wolves had gazumped their potential USL territorial rights. Any evidence of MLS "poaching" Armada?
Don't forget Austin as well. It will be interesting to see how the USL team in the Cotton Bowl does in comparison to FC Dallas. Without any USSF rules governing markets (which probably wouldn't hold up in US courts,) there's nothing to stop MLS, USL and other leagues from co-locating teams. At the end of the day, if the market can support multiple teams, why not? As for the teams in NISA, hopefully they can move when the league inevitably folds.

≈======== you hit the key issue.....legal we will never have a well organized soccer structure because everyone wants to be their own league and team etc. and when they don't get it, here come the lawyers. then throw in MLS closed system where they seem to call more shots than USSF, well, its all a cluster...

Right and Chattanooga FC found MLS Next Pro because they're barred from USL. I imagine if Jacksonville are a success they'll find the $1M to join USL L1 and then people can argue whether USL "poached" them.
I believe all four teams that jumped to USL found greener pastures. Their refs are getting paid, matches aren't forfeited, and they have a TV deal. It will be interesting to see how Miami FC does when Inter Miami moves from Ft Lauderdale.
Let's not forget that Miami FC is moving to Homestead (supposedly), around 35 miles south of Miami Freedom Park, and a 10k stadium of their own. https://www.sperformancehub.com/ I'm not sure which of these two concept images are the one they're supposedly going with, or even when they plan to open it.
