For the record I've spent some time engaging with the online community mentioned (Scott Alexander) in the article over the years and I absolutely would not be surprised if Luigi had spent time in that community based on the books he reported reading.
What a case. ADA says they're listening in on all of his calls, including the ones with his lawyers "inadvertently". Pretty sure that has to be illegal and at least a mistrial. @yossarian ?
Well first of all, you can't have a mistrial until a jury has actually been sworn. I'm sure you just meant to ask whether the indictment should be dismissed. The short answer is most likely no. But it depends on the what the details/context are. All prisoners know that their phone calls while incarcerated can be recorded. But conversations with counsel would absolutely be privileged. I haven't read this story so I don't know if he was talking to his counsel over the "jail phone" or in person when the ADA was "listening." But the remedy would be that anything he spoke to his counsel about could not be used as evidence. It would be inadmissible, and the ADA could be sanctioned if he/she is trying to listen in on privileged communications.

I'm curious as to the actual actions being investigated. Have you seen anything other than what is in that article?
This guy’s company had staff at nursing homes delay transfers to hospitals in order to save money. They also allegedly changed health care directives to reduce interventions, like changing patients to Do Not Resuscitate status, against their wishes, also to save money. CNN has an article that’s for subscribers only so I can only read the headline…but there’s gonna be a musical about Luigi. In another thread I commented that at least societal collapses usually lead to great art. I suspect this musical will not be a piece of evidence in favor of my thesis.
