"Selfish Corruption". Its a new form of government. You see, Facism implies a greater goal on behalf of the nation state. "Selfish Corruption" is merely at the sole behest of the individual. Its serves no other greater goal. For example, 1 pardon given, 1 massive and ridiculous endorsement returned. A transaction fundamental to how "Self Corruption" is run.
Judge Sullivan isn’t going to rubber stamp the Flynn pardon. This is going to be interesting. Judge Emmet Sullivan WILL NOT let Trump/Barr/Flynn kill justice. He’s accepting “friend of the court” briefs on the issue of the validity/legality of Trump’s corrupt pardon of Flynn. Let the challenge of abusive presidential pardons commence. Because #JusticeMatters https://t.co/cUQiEv48ba— Glenn Kirschner (@glennkirschner2) December 8, 2020
This is a good move In particular, I agree with Marcy Wheeler that the Court should require to know, exactly what criminal conduct is pardoned.
Rather than just name drop, can you link her comment? Marcy's website, emptywheel.net, is really quite good and people should read it. Side note, I agree with her. If the DOJ were to investigate Flynn on another matter, how are they to know if he has been pardoned with it? A blanket pardon like this just means there will be a chilling effect on investigating Flynn or they will first have to litigate whether a crime they are investigating is covered by the pardon or not. Not to mention the whole issue of whether or not Trump is pardoning a co-conspirator, which should be a big no-no.
Looks like Tribe was shot down because he did not send in the $100 fee with his request. But former Watergate prosecutors can file a brief. I see it being something like "OMFG! THIS NUT IS A MILLION TIMES WORSE THAN TRICKY DICK. DEMOCRACY IS BARELY HANGING ON. CALL THE JUSTICE LEAGUE! AAAARGH!!!"
She has been mentioned so often in this thread I figured everyone knows her Failsons and Kraken Conspiracies: Three Mike Flynn Hypotheticals Trump May Have Tried to Preemptively Pardonhttps://t.co/SMCg00t6AK— emptywheel (@emptywheel) December 4, 2020
I looked up the judge. He was appointed to this post by Clinton in the 90s. His prior two federal judgeships were Reagan and Bush I appointments respectively. Ah: the good old days before an appointment to the bench was a patronage gig for a career hack.
I feel like everyone should know the guys name by now. He’s Sully in our house...and I’m not even distantly related to an attorney. he’s the judge that also refused to allow Barr to drop the prosecution of Flynn during the sentencing phase after he pleaded guilty...twice. Appointed someone to argue against both the prosecution and the defense’s motion to dismiss. A couple of other good ones over the course of this shit show (ordered Dejoy to clear mail distribution centers for ballots every day and report back to him daily...otherwise would find him in contempt.) does not ******** around.
Since Durham’s investigation isn’t worthy of its own indictment thread…I’ll put this here JUST IN: Clinton campaign lawyer Michael Sussmann was acquitted of lying to the FBI, in the 1st trial of special counsel John Durham’s investigation. The verdict is a major defeat for Durham, who has spent 3+ years looking for misconduct related to the Trump-Russia probes.— Marshall Cohen (@MarshallCohen) May 31, 2022 I think the Mueller v Durham match is current 8 or 9 to 1. I don’t think Durham is going to pull this one out. What a joke…
TURLEY: “I mean, he is facing a jury that has three Clinton donors, an AOC donor, and a woman whose daughter is on the same sports team with Sussmann’s daughter. With the exception of randomly selecting people out of the DNC headquarters, you could not come up with a worse jury” pic.twitter.com/RHqen6AMAc— Benny Johnson (@bennyjohnson) May 26, 2022
Yep. Marcy Wheeler has covered it in detail but I gave up on it ages ago when it was clear this was a huge exercise in blowing smoke. The key point is that Sussman and the Dossier has nothing to do with the Mueller investigation. It's all part of the Trumpian attempt to hoodwink the rubes that the Mueller investigation was based on the unreliable dossier and thus its all a conspiracy
That would explain the weeks and months of deliberations as the non Clinton and AOC* supporting jurists tried to convince their obviously partisan counterparts the merits of a guilty verdict. Wait…what? They deliberated for hours? honest question….do you ever get tired about being wrong about everything? Does it ever make you go back and reevaluate the choices you make? The opinions you have? * WTAF does this have to do with the point you couldn’t make it the first place?
BTW - this is example number 653 of what a coward Garland is. Absolute coward. Has neither the character or the fortitude for the job. Worst AG since Bill Barr.
Agreed. This prosecution was an absolute joke. We know the FBI were already running a counter intel op, and people like John McCain sent the dossier to the FBI independently Even if Sussman did lie to or mislead the FBI, that doesn't change the substance of the allegations against Trump
no no no i have complete faith in our jury system and that a fair jury was picked (90% Clinton and 4%Trump voters in DC) in this DC based trial presided over by (Obama appointed) Judge Cooper
Marcy has a good writeup on this fiasco if anyone wants to catch up on it. I laid out 7 instances where Durham's prosecutors blew off orders from Cooper -- in two cases, just minutes after he issued those orders. All as part of an effort to criminalize as a conspiracy totally legal activities.https://t.co/AnInWoMDO2— emptywheel (@emptywheel) May 31, 2022
So like I say, I hadn't followed this closely, so I hadn't realised that Durham was selling a bizarre conspiracy theory https://www.emptywheel.net/2022/05/...ussmann-hillarys-successful-october-surprise/
