In the EPL West Ham and Bolton have surpassed the magic number of 40. Yet one of them will be relegated. I think a Bundiesleiga club was relegated several years ago with 42 points. Is that the record for a relegated team in the big four (Spain, England, Italy, Germany)? If not who holds it?
Interesting question. Someone will have to do the math to come up with the percentage of points earned to points available, though, since they play fewer games in the other leagues.
