    Senator Mark Kelly's response to finding out that the pentagon is considering investigating him over suggesting that (gasp) the military should follow the law and their duty.

    (This is where it starts crossing over into another area of interest of mine, since both he and his twin brother Scott Kelly were astronauts)

    " When I was 22 years old, I commissioned as an Ensign in the United States Navy and swore an oath to the Constitution. I upheld that oath through flight school, multiple deployments on the USS Midway, 39 combat missions in Operation Desert Storm, test pilot school, four space shuttle flights at NASA, and every day since I retired – which I did after my wife Gabby was shot in the head while serving her constituents.

    In combat, I had a missile blow up next to my jet and flew through anti-aircraft fire to drop bombs on enemy targets. At NASA, I launched on a rocket, commanded the space shuttle, and was part of the recovery mission that brought home the bodies of my astronaut classmates who died on Columbia. I did all of this in service to this country that I love and has given me so much.

    Secretary Hegseth’s tweet is the first I heard of this. I also saw the President’s posts saying I should be arrested, hanged, and put to death.

    If this is meant to intimidate me and other members of Congress from doing our jobs and holding this administration accountable, it won’t work. I’ve given too much to this country to be silenced by bullies who care more about their own power than protecting the Constitution. "

    The one thing Trump can't stand is to fail publicly and in a way that makes him look weak/incompetent. Based on your use of 63 days, I'm assuming you're talking about the reporting in CNN that she has been frozen out on the discussion about whether she has a job.

    I saw a Legal Eagle video today that noted the issue with Halligan's appointment isn't just that she was appointed illegally as US Attorney, it was that Bondi messed up by not also appointing Halligan as the assistant US attorney and special counsel as well. The video cited the example of Alina Habba's appointment as the interim US attorney for NJ that was not legal, but her appointment as assistant US attorney and special counsel were legal, so while Habba was not NJ's US attorney, cases in NJ were still legal.



    That being said, since the video, a 3-judge panel in the 3rd circuit did just say none of the maneuvering by the Trump administration to appoint Habba as NJ's US attorney were legal. So..... Get ready for SCOTUS to say it is legal because Trump did it.

    I think SCOTUS will punt. Both Halligan and Habba are clowns, so I'm assuming SCOTUS would prefer somebody with skill to approve.

    And that video is not showing up for me. Is that happening for anybody else?

    The Virginia State Bar has declined to open an ethics investigation into Trump prosecutor Lindsey Halligan — at least for now.

    I recall this being the belief from some. Meaning that the complaint fell within the bounds of the court and not the bar. The question, though, is who can charge her? It is limited to the DoJ, or can Congress step in here?

    This seems like a good spot to put this.. While it doesn't have anything to do with Jim Comey, it does, however, have to do with his daughter, Maureen Comey. Maureen was fired in July on the direction of Trump and she filed a civil complaint to get a judge to determine if Trump has the power to order the termination of a civil employee.

    DOJ demotes Lindsey Halligan's criminal chief as her office weighs new charges against Jim Comey, Tish James. Nearly two-decade EDVA veteran replaced by a North Carolina transplant.

    For those unaware, the North Carolina transplant assisted Lindsey the Insurance Lawyer post Grand Jury.

    Halligan has not been confirmed by the Senate, so they can't really impeach her and the DOJ isn't about to punish her since it would be an admission of them making an error in appointing her.

    The Virginia bar's standpoint is that it would be up to the judge(s) that are hearing Halligan's cases to sanction her. They could then refer her to the VA bar for punishment if they wanted to

    The CSRA - Civil Service Reform Act of 1978 - which M Comey's attorney references, has a process in which civil service employees must go through if they are fired. Trump is saying that he can just fire her because he is President, but according to the CSRA, that only is for "titled" civil servants. Not sure what "titled" means, but I'm guessing at least senior level, if not more specifically those at the level that would receive Senate confirmation.

    The fact that she isn't going through the arbitration case is an argument that the Feds are going to make in an attempt to get the case dismissed. Comey's argument is that because she was fired by the President, the lawsuit is required to determine if Trump has the authority to fire her. Also, because Trump hobbled the review board, then stuffed it with GOP loyalists, she doesn't think she'll get a fair hearing.

    Yeah, one of the legal pods I listen to talked about this a bit back. I don't remember the details, but there was something about Trump skipping the legal process, even if Comey knew his decision would get upheld, and that while this case is specifically about Comey, it effects all the other civil servants that got fired, specifically under DOGE. There were other names mentioned on that pod, but don't remember who they are.

    James has been no billed. Or should I say the DOJ has been no billed.

    Prosecutors went back to a grand jury in Virginia after a judge’s ruling halting the prosecution of James and another longtime Trump foe, former FBI Director James Comey, on the grounds that the U.S. attorney who presented the cases was illegally appointed. But grand jurors rejected prosecutors’ request to bring charges.

    Federal judges in Alexandria, Virginia, have lashed out at the Justice Department as they continue to list Lindsey Halligan on court documents — some going as far as striking her name from paperwork from the bench.

    Two magistrate judges and a district court judge in Alexandria, Virginia, told prosecutors in open court they didn’t believe Halligan’s name should be on new criminal case filings, such as guilty plea documents and indictments, after a decision in the district last week said she is not the US Attorney.

    One of those judges, Magistrate William Fitzpatrick, said at a criminal case hearing Tuesday that filing criminal charging papers “under Ms. Halligan’s name” at this time “is simply not acceptable,” according to a transcript obtained by CNN.

    Seeing as Lindsey the Insurance Lawyer's #2 is a career DoJ person, or at least somebody with ability, I have to think this was intentional.

    Seeing that the DoJ has yet to file an appeal of the disqualification ruling. @yossarian what kind of time frame are we looking at, and how does this effect Comey's SOL clock?

    Well, one of Trump's unlawfully US attorney appointments has resigned her position. Unfortunately it is not Halligan, rather it is Alina Habba, whom Trump unlawfully appointed to US attorney for New Jersey. Habba, of course, didn't make reference to the fact that she was properly appointed and that she had lost her appeal to an early ruling that she wasn't lawfully appointed. Instead, she claimed to be resigning to preserve the stability and integrity of the US attorney office. LOL
