The real issue is with programmatic advertising the advertisers don’t have much oversight into where their ads appear. It takes something like this for them to realise at a high enough level that there is an issue

Everyone point and laugh at Musk. So, he filed his lawsuit against Media Matters today, but rather than claiming that Media Matters' article was inaccurate, he's attacking them for tailoring their results to support their claim.

    https://www.cnn.com/2023/11/21/tech/elon-musk-texas-lawsuit-media-matters/index.html

The accusation is that Media Matters created a new account, started viewing and following known neo-nazi accounts and posts to train the algorithm to show them Neo-Nazi posts, then took pictures of the ads that appeared with the posts... So, basically, Musk is super mad that Media Matters created the experience a neo-Nazi twitter user would have and wrote an article accurately saying that ads for major companies appearing next to posts by actual neo-Nazis.

The article above notes that Musk forum shopped by selecting a west Texas federal court that has a Trump appointee that has taken a pro-Conservative stance in his rulings since being appointed. I do wonder whether it will stay there as Media Matters will likely note that the investigation took place outside of west Texas and that Twitter's HQ is in San Francisco. That should give them grounds for a venue change, but who knows! Forum shopping is "common" among such lawsuits and given the persuasion of the judge, it could work.

One thing to add to the above is that another claim MediaMatters will use is that by filing in Texas, X is avoiding California and DC's anti-SLAPP laws which would allow MediaMatters to file a counterclaim to get their legal fees back (plus extra).

Can a state law be utilized in a federal case? That seems odd to me.

Also, as part of discovery, won’t Media Matters be able to access X’s algorithm code?

    No.

Anti-SLAPP laws wouldn't apply in a federal case in any venue.

Before this current outrage, Twitter's ad sales were already down over 50% year-on-year, and as has been noted in this thread, user count is dropping and that trend is increasing. Twitter was a dead man walking before Media Matters did anything. It's just that something the size of Twitter can keep walking for a while.

Right - this new scandal/crisis shows what is really killing twitter. Top line Revenue.

MDAU (monetisable daily active users) being down is not cool or great (app instals are also way down), but Musk's problem is not really that, and MDAU was a made up metric by the previous twitter leadership to try to hide poor performance. Basically Musk has enough inventory - it's advertisers he lacks

Alex Kantrowitz at Big Technology podcast has drilled into Twitter's ad tech over the last year and why is it simply shit compared to Facebook and Google.

tldr it is not very good at targeting and now is way worse. So in election year - a cash bonanza normally, Team Elrond have broken ad tech which can't prevent your ad spend going against nazi content

In the before times, big companies would look at their billion dollar ad spend and throw twitter 10m in crumbs. Yacc is supposed to get that money back and more, as a high end ad exec. This scandal is the proof that her efforts aren't working

    Whoops

Basically they sent nazi signals to the algo to get served nazi content and the adtech allowed blue chip ads to appear. This is what Yacc pretended was all fine at CODE

BTL Yacc has kind of said sure there is nazi twitter because reasons, but only nazis have to see it, and of course Apples ads never go there. But that doesn't work.

Was there ever a bigger fraud than Matt Taibbi?

Yo, @kenwhite.bsky.social and @jkosseff.bsky.social I'll have you know that Matt Taibbi, recent winner of a $100k award for free speech from the "National Journalism Center," now thinks it's cool for the courts to punish media orgs that get stories wrong.

    Peak Musk everyone

Congrats To Elon Musk: I Didn’t Think You Had It In You To File A Lawsuit This Stupid. But, You Crazy Bastard, You Did It!

But, then, on Monday evening, the lawsuit finally came, and it was glorious. Gloriously stupid.

Honestly, this feels like what you get when you have a rich but legally ignorant dude who announces on a Friday that there will be a lawsuit on Monday and finally finds some terrible lawyers who are actually willing to file something just to live up to that promise.

It’s not a good lawsuit. It’s barely even a lawsuit at all.

    ...

so… within the span of about 2 to 3 pages we are told that Elon Musk and exTwitter are passionate supporters of free speech that allow “all viewpoints” to be shared and that Musk is filing this lawsuit to force Media Matters to take down speech that he admits is absolutely true, but where he doesn’t like how they portrayed things.

Anyway, kudos to Elon. This really takes stupid SLAPP suits to incredible new levels. I didn’t think you’d be able to find a lawyer who would file a lawsuit so stupid, that makes you look this ridiculous, but you did it. Just like people doubted your ability to shoot rockets into space or make popular electric vehicles, I should not have doubted your ability to file absolutely nonsense SLAPP suits that are this laughable.

    From the article

"The press still lives and dies on Twitter, and as long as they’re there, it’s going to be hard for elected officials to avoid it,” said Andrew Bleeker, president of Bully Pulpit Interactive, a Democratic-aligned communications firm.""

"Raskin told POLITICO he could see a day he leaves the platform, saying he believes there “could be a breaking point if nothing changes.” And he said it’d send a more powerful message if there was a mass lawmaker exodus. “I would definitely reassess with my colleagues — this has more significance if a lot of people agree to do it together.”"

BTW is funny how on top of the page in the politico website, you can share the article on Facebook and Twitter, but not on threads. Lol.

Goldman is correct IMO. The whole point is to defeat fascism not hand victory to Musk

so long as they can reach voters and journalists there they should.

Of course the migration is well underway so they all focus on other platforms as well now

The Judy Garland remake. If y'all haven't seen the original one that came out in the...late teens I think...it's wildly different.

Apparently Elon Musk voiced his support for the Pizzagate conspiracy theory this morning.

He is a sick ************************....24 hours after Bibi gave him the welcome tour....

“Elon Musk voiced support Tuesday for Pizzagate, the long-debunked conspiracy theory that led a man to fire a rifle inside a Washington, D.C., restaurant in 2016,” the Washington Post reports.

“The far-right theory, a predecessor to QAnon, alleged that the Clintons and Democratic Party leaders ran a secret satanic child sex ring in a D.C. pizzeria known as Comet Ping Pong.”
