Federal habeas corpus is a procedure under which a federal court may review the legality of an individual’s incarceration. Miller told the blogger, Jordan Conradson, he had made a point of calling on first: “The Constitution is clear, and that, of course, is the supreme law of the land, that the privilege of the writ of habeas corpus can be suspended in time of invasion. So it’s an option we’re actively looking at. Look, a lot of it depends on whether the courts do the right thing or not”. Miller’s use of the word “invasion” reflects the Trump administration’s argument that the US is under invasion from undocumented migrants and so the president is justified in claiming the power to deport anyone the administration brands a suspected gang member, with little to no due process under the rarely-used, wartime Alien Enemies Act. A recently declassified intelligence assessment, however, shows that US agencies do not believe that the gang Tren de Aragua is operating on behalf of the government of Venezuela, as the administration has claimed as justification to use the Alien Enemies Act. Imagine running a business which is dependent on Chinese goods. Firstly huge tariffs, then suspended for 30 days, then reimposed maybe, then discovered there’s an Apple exemption, but not for you, then skyrocketing tariffs nudging 200%, then reduced but not eliminated for 30 days maybe and no guarantee anywhere anytime that even the best deal supposedly being put forward will happen or if it does that it’ll last longer than half a financial Quarter. Yep, it must be so easy planning growth, revenue, sales and how much to ask the bank for in loans. Real easy.
