I don't think it's a question of choice, I truly think they are hamstrung by Chivas Regal and even though the pronunciation and meaning are totally different, when it comes to trademarks and copyrights, most lawyers are overzealous. If I was a betting man, and I'm really not, I would bet this team would be called Club Deportivo de Los Angeles and will try to get around the legal stuff by nicknaming themselves the Goats and then just hyping things in Spanish (and calling themselves Chivas). I do not think they will market to the English-speaking market.
The brand is Chivas Regal; the team name is Chivas. I don't think the scotch whisky has anything to do with goats; frankly I'm not sure how the Chivas bit originated. Naming the team Chivas Regal would be a problem, but I don't see the Spanish word for goat posing a problem as a team name. On the other hand, I once cut out all use of the word 'fvck' in a play I wrote, because I didn't want to pay royalties to David Mamet.
FWIW, peoples: You can bet the kids: the club name will be Club Deportivo Chivas; w/ "Chivas-USA" as a nickname.
I'm not entirely sure why you would "truly think" this unless you knew intellectual property law. Yeah, lawyers are overzealous, but trademark problems arise only when there's a possibility for confusion. So the fact that the pronunciation and the meaning are totally different are quite important. I would think (although I do not know) that some form of the Chivas name/logo would already be registered in the US, given all the merchandise sales.
CD Chivas I can totally live with. I know this season isn't overwith yet, but I can't wait for next to start. BTW, I though it was odd in the announcement that they said 'name and colors' will be announced. I have a hard time imagining Chivas is Chivas without the name and the red/white stripes, blue shorts.

If CD Chivas is chosen, perhaps DC United should be rebranded to avoid confusion. How about... CD United (Deportivo Club United never made sense!) CD DC (easy to remember) AC DC (works on many levels) FC DC (DC United has English roots, after all) FC United (sounds more soccerlike, makes as much sense as CD Chivas) FC Washington (at least the Dallas folk will know who you're talkin' 'bout)
In fact, this may just be the second generation MLS strategy... The first was try the singular Mascot names that are not animals to be original. Now it's the put a "soccer" phrase in front of a City name ... FC Dallas, Real Salt Lake , Chivas LA or CD LA. Club Houston, Bayern Seattle, PSV Rochester, Ajax Philadelphia (The Pennsylvania Dutch) , FC Internazionale Miami, Borrusia Cleveland , Boca Oklahoma This could be sorta cool.

I only know of two teams that have those two Deutsch words placed in them. Those being Borrusia Dortmund, and Bayern Munich. Quite frankly Real Salt Lake City is stupid as hell. How many people live in the SLC area that consider themselves Hispanic? Not a whole lot...let us try not to mimic everything that Europe does. I love soccer (or football) and I watch my share of games that take place across the pond, but damn it, this is the US' league.
