Tyler Technologies has sucked for the past 10 years. They did manage to work out some of the awfulness from the initial court e-filing site, but they still suck. (I was asked to become a trainer for them when I ran the legal clinic in Chicago, as I and one of my associates were training so many students and staff and paralegals, etc. We said "Yeah, no thanks").

I have read the Executive Order*. It is not quite what the various news articles are saying. They are not creating "ICE-free zones" and should not be called that. ICE can arrest with a Judicial warrant, like any other law enforcement agency. The City cannot stop that. However, that is not what ICE generally does. I do not know if this Executive Order will stand up in court, but it could be a VERY positive step in the right direction. First, it states that public lots (and any private lots that wish to participate) can put up signs stating This property is owned and controlled by the City of Chicago. It may not be used for civil immigration enforcement as a: Staging Area Processing Location, or Operations Base Second, it can slow down the crazy "raids" and fascist strong arming we have been seeing. Well, as of right now, ICE are NOT required to identify themselves or present JUDICIAL warrants when they conduct a raid. There is no law that I am aware of that states that ICE has the right to be on any non-public or non-federal property without a Judicial warrant. In fact all of the research I have looked at states they do not have the authority to enter private property. An argument could be made those ICE agents are trespassing UNLESS they have a Judicial warrant. Note, this is not the same thing as an Administrative Warrant, which is merely a piece of paper created by ICE to identify those they aim to detain “Warrant for Arrest of Alien” (Form I-200) or “Notice of Custody Determination” (Form I-247) The Executive Order is fairly carefully worded to say this EO is NOT interfering with the "execution of lawful judicial warrants or the enforcement of criminal law." Of course, the White House had a reasoned, measure response! We cannot expect anything else from them. Obviously an executive order can’t stop legal proceedings but it can interfere with the illegal ones.
If an executive like the President can issue executive orders with dubious legal validity why can't an executive like a Mayor?
Not really, but close. It is not a question of legal v. illegal. The way I read the Executive Order is differentiating between Judicial warrants, which require compliance and Administrative warrants, which do NOT authorize entry onto private property. ICE are using deceptive tactics to enter private property. Sometimes they shout "Warrant" and, well, we have all watched enough cop shows to know that "means." The problem is the cop shows are (of course) talking about Judicial Warrants, signed by judge. That is not what ICE are using for many people who are undocumented. They are using Administrative warrants, signed by an ICE official and do not grant entry onto private property.

This is just how he got to Congress. Gutierrez did precisely the same thing for Chuy. Chuy (like Gutierrez before him) was my Congress critter in Chicago. He was a nice guy, but did not do much for his constituents.
