To make your comparison even remotely relevant you have to assume that the cops get to decide what behavior is considered criminal. The FCC should only regulate bandwidth and other technical matters. They need to get out of the speech police business.
People speed all the time right in front of cops and don't get pulled over. The FCC enforces statutes, they don't have plenary power to make up the rules. A cop is enforcing a criminal statute, too. A cop can exercise discretion and so can the FCC.
I only get pissy when they are unreasonable. I consider this unreasonable - especially the size of the fine.
But I'm sure if the fairness doctrine, designed to limit political speech from the right, was put back into place you would consider that reasonable, right. And this is the big problem. It is the consumer that should be the arbitor of what is decent and indecent. What's reasonable and unreasonable. It should not be the federal government with their warped concepts of what is good and what is fair and what is tasteful. I mean there is still a 1st amendment, right?
