I'm just waiting for the Republican candidates to make their entire platform that they will pardon Trump first if they win presidency.
Comparatively few are ending up with felonies on their record. In fact, a Federal judge scathingly criticized the DOJ for exactly that.
As I understood your point, Garland waited for the Jan 6 committee to finish before he went ahead and did his thing...or what ever it was he was doing. But had he acted immediately, it is possible he could have gotten those messages, despite the actions of those who erased them. That was half my point. The other half was being critical of Garland for not acting on his own/independently.
According to the figures linked below, 60% of the 500+ people sentenced so far have received prison time (this despite the fact that the overwhelming majority of them have pleaded guilty in exchange for leniency). https://www.npr.org/2021/02/09/965472049/the-capitol-siege-the-arrested-and-their-stories Maybe you're a tough guy who would shrug off a few months in Leavenworth - but for most people, the prospect of any significant amount of time in federal prison is a pretty strong deterrent. That's a big part of the reason that, despite Trump's relentless efforts to mobilize unrest, the only people who showed up for his NY indictment were a small number of weirdo protestors.
Merrick Garland was confirmed as AG on March 11, 2021. The text messages were deleted by the end of January, 2021. Perhaps you see an issue here…
Preet Bharara had a very good interview with the lead counsel ofJ6C where the guy confirmed your thesis. DOJ lurched into action after Hutchinson. Smith was appointed quite a bit later, after the documents were found at Biden's.
It's really difficult to know exactly what DOJ was doing in those 18 months after Garland was appointed but the most convincing argument made by Preet and others (e.g lawfare) is that these defendants are leaky. The second DOJ started talking to them, we started to find out about it - and as per j6C counsel - that only started to happen after the hearings when DOJ heard their testimony. We know DOJ did not interview these key witnesses before the j6C hearings which is an enormous failing by DOJ when you consider their powers to compel testimony compared to congress. Some have the theory that DOJ waited for the political cover of j6C. I don't believe that.
I was gonna respond too, saying the texts weren’t the key issue. But you’ve said it all here. The other issue is these ********ers have had time to dig in their heels. They should have been sitting in jail awaiting prosecution or under house arrest and a gag order. Instead, they are grifting their way to the good life, making it all the harder to hold them to account.
I think it's important we don't get into revisionism about '16-20 DOJ/FBI and Mueller did investigate and indict the crooks. For all their failings the media did in fact report the horrific facts for years. Then Mueller's report laid it all out. Trump appointed a corrupt AG who spiked the guns. Congress and voters are the only ones who could hold him accountable for that. IMO the Garland period from '21 is a much greater failing that 16-20. Garland has none of those political issues AND Trump did a far worse crime (the coup) on top of his other crimes. IMO the Trump DOJ/FBI did far more to hold Trump accountable than the Garland DOJ (so far)
Sorry. This is bullshit. Nobody here expected him to be convicted in the senate. Nobody. What I personally didn’t expect was Garland politicizing the DOJ by choosing to do nothing and being a complete coward. But he’s now been forced to act. I’ve been banging on this since the beginning. Everyone claiming the DoJ was investigating in silence was full of shit. There was no way people in trumps orbit were going to keep their traps shut if interviewed by the DoJ. FFS….think of all the leaks from the Trump White House. Silence was impossible. Within weeks of Smith’s appointment we got weekly leaks.
I believed Trump would be indicted swiftly for the coup. It amazes me that it still hasn't happened. It wasn't a secret! He told everyone what he was doing! Yes. 100%.Shameful really.
That isn't how the US justice system works, especially for white collar crimes. It takes years of investigations and just as long for pre-trial, trial, and appeals. Anyone that thought Trump would be in jail by now was kidding themselves.
Ahhhh. OK. I thought the one they were charging for interrupting federal proceeding was a felony. Turns out, it is just a class-a misdemeanor.
Going by memory, SD. But seems like all the 1/6 grunts are getting arrested, convicted & doing some time. None of the organizers and folks on the political side.
Two questions: 1) is his a resource issue with the courts/DOJ or does the actual work take that long? 2) Isn’t Jack Teixara in jail now? It’s not like he committed a violent crime.
