The article says it's the federal Gun Control Act of 1968, which says that anyone "who is an unlawful user of or addicted to any controlled substance" can't buy a gun. The ATF has interpreted this as anyone who has used drugs in the last year can't buy a gun. It sounds like gun dealers make you fill out a form that says you're not a drug user when you buy a gun. This is assuming that Reason isn't lying to us. In any case, if the law is as described, I guarantee that it's been used more to block women and POC from buying guns than any white people.

Assuming that Reason Magazine isn't lying about this, it looks like it's self-attested - people fill out a form saying they don't do drugs and they can have a gun. To the extent that a law like this is enforced, it's going to be enforced on black people. "Well, sir, you said you don't take drugs, but I imagine you have a history of being addicted to the crack cocaine, so I'm not going to sell you this gun" while the scruffiest white methhead gets their gun, no problemo.
And it is also something that is only enforced after the fact as an add-on to additional crimes. In Hunter's case, he is being charged with falsifying government records because he said he had was not taking drugs when he filled out his background check form for the gun. If Hunter wasn't being investigated by the FBI as part of the Republican witch hunt, his lie on the background form never would have been found and never would be prosecuted. If the ATF were serious about the requirement, they'd require a pee test to prove someone wasn't on drugs as part of the background check.
