    Yes. Because, for the most part, they are the ones that made them that way. The entire conservative media ecosphere, of which Fox is the dominant propagator of information, is built around radicalizing the consumers of their product. If Fox's talking heads don't like their audience, they have absolutely no one to blame, but themselves.

    Things keep going sideways for Fox.. It's almost like they are a corrupt organization..

    A producer for Tucker Carlson's show is counter-suing Fox for discrimination and retaliation after Fox sued her to prevent her from testifying about certain things in the Dominion lawsuit. She is claiming they are attempting to force her to provide misleading information.

    Ex-Tucker Carlson producer files new claims Fox News lawyers coached her testimony in Dominion lawsuit
    The former Tucker Carlson producer who sued Fox News last week alleging she was pressured into giving misleading testimony about the network’s coverage of supposed election fraud has filed new allegations about coercive coaching by Fox lawyers, bias and unprofessional behavior by staff members, and retaliation by the network.

    In papers filed Monday morning, Abby Grossberg seeks to correct the Sept. 14 deposition she gave about the network’s coverage of Dominion Voting Systems, which she says was tainted by pressure from Fox lawyers. Grossberg alleges she was not able to see a transcript of her testimony before it was made part of the record, even though she requested a chance to see it six times, while male colleagues were allowed to see their transcripts. She says she was able to review and correct it only more than five months later, after she retained her own attorneys.

    It is worth noting that while the case will go to trial, that the only thing left to decide is if Fox defamed Dominion with actual malice. The court did make a summary judgement on whether Fox lied. As highlighted in the tweet Dapip quoted, the judge says it is CRYSTAL clear that the statements Fox made in their broadcasts were false, so there is no need for a jury to determine if the statements were false.     So, basically, Fox's last hope is if the jury believes their 1st Amendment claims and that all they were doing was reporting on the news and that it was news to propagate the lies coming out of Trump's camp without question.

    But that won’t work for the nighttime talking heads who offered their opinions. That might protect the shows that at least lurch toward being journalismesque, and report statements by pols or do interviews.

    But Tucker and Judge Boxwine and the rest can’t use that.

    Fox will claim the talking heads are journalists as well... And yes, I am aware that in previous cases they claimed they were not journalists, but that won't stop them from trying to walk the line.

    No. First Amendment defenses won't help them at this point----now that Dominion has been granted SJ as to falsity. This is really big. I can't stress enough how rare it is for a plaintiff to be granted SJ on one of the elements of their claims, especially in a defamation suit like this.

    Yes, Fox will appeal this decision immediately, but it's a really big deal.

    Okay, why doesn’t it help them? I understand that the judge ruled there is no question about the falsity of their statements, but a lot of the legal pundits I see on the Twitter machine are saying the 1st amendment’s “freedom of the press” means “actual malice” must be proven by Dominion.

    Let’s take Palin’s case against the NYT, their claim that the targets on a map was posted by Palin was false and NYT conceded that. Where Palin’s legal team fell flat was their inability to convince the NYT did it with malice.

    The point I meant to make but didn’t is that Tucker makes statements about his beliefs. The daytime folks do interviews, read news, etc.

    I agree with you. I’m just saying Fox’s argument will be that it doesn’t matter the underlying facts were false and that they knew it was false, they were just reporting on the news and that will extend to the talking heads. Fox will try to have it both ways. They’ve won previous cases claiming the talking heads were just making opinions, but they’ve already lost that part if the case, now the actual malice ir bit has to be decided.

    The "news" isn't an objective thing. There is an active, conscious editorial decision to pick what to put on the air.
