Right...America needs fan media that can't come up with an original name for a podcast. Sure, Jan. Sure. Naive blogger/podcaster didn't research trademarks prior to starting their endeavor. News at 11.
At risk of being a corporate shill: If SKC is really using that trademark, they risk losing the trademark rights if they don't enforce it like that.
Not a corporate shill. We have patent/trademark law for a reason. The burden to research existing trademarks is on the new venture. If they don't then a person/entity with legal rights to the trademark can issue a cease and desist. These guys are using the issue to gain notoriety and get their name out there.
Two things this brings to mind. First, the fact that the team was originally the KC Wiz before they were threatened with a trademark suit and changed it to the KC Wizards. Second, that there's been a long running youth tournament in Colorado that got started as the Rocky Mountain Cup but has changed titles multiple times and now no longer uses that. They never filed a trademark on it so when we did for the MLS trophy there was no objection. We have never told them to stop using it though, that was something they did on their own.
I keep my caveat in there because it's possible that the podcasters have a case if they were to fight it. They claim that the trademark wasn't registered at the time the podcast started. I don't know if that's true, and paying for the legal fight isn't going to be worth it in any case. But the takes saying "How dare they use LAWYERS to enforce a trademark" are silly.
