I'm not sure where you are hearing that it'll be hard for Dominion to prove malice. Maybe you are misunderstanding what malice means in the legal sense. It doesn't necessarily mean they did it with the intent to harm. https://www.mtsu.edu/first-amendment/article/889/actual-malice Based on analysis that I've seen from actual legal experts, Dominion has pretty much proven that Fox knew that what they were running with was false, but did it anyways. The only place that Dominion may run into issues is the "News" label part of Fox News's name. Fox is going to lean pretty hard into claiming that they were just reporting on the story and not actually propagating the lie. That may be hard as in previous lawsuits, Fox has claimed their talking heads are not news shows, but rather opinion shows, therefore, they should be held to the same standards as a news show.
The stuff I've heard is that this case is so "on the nose" that law professors wouldn't even propose this case as a case study of defamation in class, because it's too damn easy.
