Breaking: SCOTUS release much-anticipated opinion in Mississippi case. https://www.supremecourt.gov/opinions/21pdf/143orig_1qm1.pdf
There is a thing happening today. https://www.pbs.org/newshour/politi...sissippi-law-banning-abortions-after-15-weeks Don't know if it's click-bait, but the Washington Post and others seem to interpret the questioning as indicating Roe vs. Wade's "viability" restruction will be overturned, leading to the ability of individual (Republican) states to restrict abortion even more, to the point of making it basically unobtainable, very likely. Personally, I was riveted to the NPR broadcast. But I think the Republicans are safe with their 6-judge supermajority, and with what they've done in the areas of voter suppression, gerrymandering, and the like - I don't think the political part of the Republican party cares at all; all the outrage will be focused in blue states and urban/suburban areas, and those votes don't count very much anymore.
Remember that pretended centrism actually helps the extremists: Asked about Kavanaugh’s line of questioning, Collins tells @alizaslav: "I did not see his questioning or hear any of the arguments. I hope to later tonight play them so that I have firsthand knowledge of what the arguments were today, but I can't comment on what I didn't see."— Manu Raju (@mkraju) December 1, 2021
MSNBC played clips of the Republican justices at their confirmation hearings and each one was like "Roe is decided law. We'll follow stare decisis...believe me" Was horseshit then as it is now. MS state pols were like "we gotta challenge abortion now with this awesome makeup of the court"
It is pretty clear that Roe vs Wade will be gutted if not completely smashed. That is the price of the 2016 elections. It is mind blowing though that in 2021, a woman right to choose can be an element of judicial debate in a modern society. This is really ********ed up..... On that related, note, the comments from ACB yesterday on the case were beyond infuriating. Her blatant disregard of the complexity of abortion and adoption is clearly coming from a position of privilege. What a repulsive person. I am so tired of fundies like ACB saying adoption is a good alternative to abortion. It is NOT. Adoption is traumatic for the child and the parent. Adoption is not a fix-all solution - it is a system that punishes babies and mothers, primarily for poverty. https://t.co/XbcTdjW7Qn— Abby Sinister (@AbbyZinger) December 1, 2021
Yep - this is just hard power which makes the actions of Manchin/Sinema even more absurd Hard to see how this doesn't just slide into democratic collapse now, as there is no real way for the Dems to ever gain ground in the court again, unless one of the young judges died surprisingly young, or somehow the Dems are always holding either the WH or the Senate.
It is all theater. Like how she spoke at the McConnell center about the independence of the Supreme Court. Just cam to me. Kayfab is what Superdave called it.
The party that controls 2/3 of the SC has won the popular vote precisely one time since 1988. Burn it down.
As is proof with the pair above, being Democrat doesn't matter. They have to be progressive or liberal, otherwise nothing will get done. And we need 10 more of them.
Even if a spot unexpectedly opens up on the Supreme Court, the Republicans in the Senate won't let a Democratic President nominate someone. They'll hold it open indefinitely.
Her family owns a plantation that was a favorite spot of Scalia. Part of me always thinks that the Union really should've burned the South beyond recognition. This is one of those reasons why.
I'm pretty sure adoption is less of a punishment for the baby than abortion. Yeah, but the absurdity of Judge Breyer is monumental in comparison. He doesn't want to retire because that would make it look like the Court is partisan. I'll repeat a point I made before. One of the liberal Supremes needs to write a dissent that's about 2 sentences long. Something like, this is a partisan decision not rooted in the Constitution or precedent. I urge the other 2 branches of the federal government to ignore it.
"Punishment" is a very strange word to use here. Hardship, perhaps. Trauma, likely. But punishment? I don't think so. Also, "babies" are not aborted, fetuses are.
When you allow the Klan to murder the government, because they're black, and do nothing about it I think what you said is an understatement.
Democrats for now have the tie breaker vote in the Senate, so unless Manchin or Sinama vote with republicans, then democrats can nominate a SC justice. After 2022, who knows how that will go. But the most likely SC justice to go first, is a liberal anyways. Thomas is 10 years younger than Breyer.
I'm currently reading The Impending Crisis: America Before The Civil War, 1848-1861 by Potter and Fehrenbacher. There's a quote in there from Charles Sumner upon Roger Taney's death in 1864, "The name of Taney is to be hooted down the page of history...an emancipated country will fasten upon him the stigma which he deserves. He administered justice, at last, wickedly, and degraded the judiciary of the country, and degraded the age." (pp. 289-290). I'm glad Taney's statues were taken down.
Yes - they can hold 6-3 forever, as long as the corrupt justices always retire with a GOP senate/POTUS before they get too old. Meanwhile the Dems hold themselves to the filibuster, which means conservatives can amass permanent minority power with the assistance of the rubber stamp court
