What cause of action would you sue them under? The government doesn’t have any legal obligation to pass laws that protect people from disease or injury. The only recourse for bad laws (that don’t otherwise violate a state or federal constitution) are elections.
I tend to agree. Which is why it’s a good time to start a more honest conversation on how we move forward. I think that the US is ambling into a Swedish approach to the pandemic, whether we know it or want to admit it.
The difference is that the Swedes know precisely what they're doing. They've gambled that they can rely on their social norms to keep deaths relatively low enough that their health system isn't overwhelmed. We can't replicate their strategy because we lack their social capital.

That’s why I said that we’re ambling in that direction. We missed the window for a hard lockdown like New Zealand, and the current approach isn’t sustainable long-term. So, we’re left with moving forward at a level of lockdown that hopefully doesn’t overwhelm our hospitals, while accepting low four-figure daily deaths for the foreseeable future.

Too many idiots. Did you see the bars that were packed in Wisconsin last night? It's as if the Wisconsin Supreme Court made the whole virus go away, and we can return to our lives from February. My guess is that we will see pockets that will look like New York in smaller cities. Look for places like Appleton/Green Bay to have waves that crush their health care capabilities. Yes, there are a lot of responsible people who will continue to do the right things, irregardless of what the government does or does not do. But this is now political. A sizeable part of the 40% that follow Trump see this all as deep state bullshit, and they will simply pack their bars and restaurants as if nothing ever happened. Our country is too big to have one massive curve. In some ways that would be better as we would have mass sickness and death for a shorter period of time. However, it won't work that way. We will have places like NY getting back to a more normal (but far from really normal) pace of life while pockets pop at different times around the country. In short, we are too stupid to follow a level of lockdown that won't overwhelm our hospitals.
