Vergara loses Chivas naming rights

    Jorge Vergara has just lost, in Mexican Federal Court (aka no appeals), the rights to the brand "Chivas".

    Kind of funny.
    I'm starting to think that he named this team "Chivas USA" for legal reasons as well.

    Oh well, yawn.

    Since this team is independent of that decision, I would think the decision is moot because the term Chivas is in our official name.
    Basically, it's a nickname in Mexico but an actual team name in the USA.
    At worse, we could be sued by the plantiff Cardenas for copyright infringement which would mean rebranding CUSA.

    Go figure.

    I think he might be rebranding... Since all their gear is on sale... even the jersey that was going to be this years kit... unlike other teams that only are selling the old kits to make room for the new ones... CDUSA is dead!!!

    It makes me think they'll be rebranding before the season. Right now, Chivas USA has no kit for 2010 on mlsgear.com

    Dear God no. LA Aztects is ugly as hell. Its funny how people that aren't CUSA have the stupidity to discuss rebranding of this team every year, and some think CUSA is a Only Mexican policy team still. To me adding LA Aztects is more Mexican then CUSA itself. CUSA or CDLA is fine. I just hope we get to keep the Red & White stripes.

    Calm down people.

    The 2010 kit was on sale for a couple of weeks.
    The sponsor deal with Comex is done and so far could not be renegotiated, therefore the kits were pulled off the store (since they all had Comex on it).

    They have been using the kits without a sponsor for preseason games. They're not gonna sell them until either CUSA gets a sponsor or it final that no other sponsor will bite and they just use the kits without one.

    One of the best names in soccer history, and a very classy connection to the hispanic roots of the team.

    I used to love the Aztecs when they played with Steve David and Georgie Best.

    But then, there was also this guy named Johann...

    Change the name and never look back!

    This is the biggest no-brainer ever!

    Relax people, Vergara didnt loose shite. To sum things up, this decision doesn't hold any weight because it was issued by a judge who isn't in the merchandising department of the judicial system. Even tho this judge said he lost it, Vergara can still take it to the merchandising court (for lack of a better word) This is what the Chivas lawyer said.

    Get a grip, trolls (er, I mean non-CUSA fans).

    We have no shirt sponsor as of yet. I'm not against re-branding, if its for the greater good, but some of you need to understand the Kangaroo court system of Mexico's judicial system.

    In the meantime, we are Club Deportivo Chivas USA.

    Sooo... I'm totally confused. Why did Vergara lose Chivas naming rights? Who own "Chivas" naming rights now? Why would a club pretty much known as Chivas for decades suddenly lose its name (or nickname) due to some judge? I'm just asking for someone to clarify the situation for me.

    Sounds like a Judge needs to get his palm greased. This is MEXICO so the decision will be adjusted after a Gentleman's agreement.

    As for CDChivasUSA, we have our naming rights under a U.S. copyright. We will still be CDChivasUSA in 2010.

    As for the uniform, they are not going to sell the shirt until a new sponsor gets slapped on the front. Sounds simple enough.

    Let me try to explain. (feel free to jump in if I am wrong)

    First, Vergara bought out all shareholders of the Club Deportivo Guadalajara. Expect for one. That would be Mr. Cardenas. Mr. C took it upon himself to hold his VERY MINOR share of the club, while Vergara completely transformed Chivas de Guad (i.e. rebuilt the infra-structure/"better" business mgmt/eliminated multiple sponsors on the famed jersey/winning at all costs attitude) starting 2003.

    Mr.C protested and decided to file suit claiming Vergara had no legal right to ownership since he did not fully own 100% of the team. Seven years later, a federal judge agreed.

    For many, Vergara has been a polarizing figure for being a Steinbrenner in the FMF. He is as cuthroat as they come. No apologies.

    He's also very smart: In recent years, he changed the famed badge of the Chivas de Guad to further distance himself from any possible judicial ruling, Established an MLS franchise with the name "Chivas" already in the name as opposed to just having "Club Deportivo City Name". The stadium he promised is almost completed (after many delays)

    Well I tried. I'm still learning more and more about the situation.

    I don't think they are haters as much as ignorant people trying to stir some sort of emotion as to promote the demise of the CUSA brand.

    It's not a debate, but there are people on BS that have no clue about what they are talking about. We honor them by responding to thier stupidity.

    Also, remember that it is pre-season and when your team lacks "drama" you go somewhere else to find it.

    Just my 2 cents.

    traditionally speaking, the whole re-branding thing has always gotten everyone's attention. honestly, i don't know why it does . . . but it does.

    btw, i think there is a ton of validity to this, and it isn't just as simple as "mexican court decisions don't count in the USA". there are several treaties that validate court mexican court decisions in the USA and vice versa, it is my understanding that copyright laws are one of these things.

    that being said, assuming that there isn't an avenue for appleal in mexico (which there is) . . . it would still require running the documents through formal channels (mexican consulate, etc) and getting the decisions translated and validated, then they would have to be entered into the US court system.

    all of that being said, i am betting that this will be settled out of court . . . which direction they go, who knows. but with this much smoke, there has to be fire (somewhere).

    either way, your team is your team . . . and the potential chaning of the crest or colors will not change your support. IMO, this is an overblown situation, as it won't impact where you guys play, who owns your team or what players you sign.
