this kid was a high school track and football star...... he was most likely on his way to playing college football. they took some of the most formative years away from this guy.

I don't agree with the court reversing the sentence on cruel and unusual punishment grounds. The statute and sentence may have other constitutional flaws, but I don't think cruel and unusual is a strong attack. Compare the story of Miami HS football player Antwain Easterling- "consensual" teenage sex isn't always victimless or without grave consequences. The state supreme court is not a super legislature and my impression is that all they did was second guess the lawmakers. I could be wrong because I skim article when this first broke. I could not find anything. That would suggest. He was never guilty but only that his crime was not jailtime worthy. You know.
