According to Sky Sports today, the latest possiblity is for West Ham to tear up his registration, and sell him to Joorabchian in exchange for a sum; anything from 100,000 pounds to millions (I suspect the lesser!) , and Joorabchian will then sell him to Man.Utd. Since he has no other interest or influence on Man.Utd, neither will be breaking any rules. He clearly is Tevez's agent and owner, and this would supposedly work. If not, and if the Premier League won't validate it, Joorabchian will continue his High Court action against West Ham, which could take months. Frankly, I don't care any more, and I'm certainly not anxious to see Tevez play against us!
Today's Independent says the same thing Leslie; West Ham set for windfall if league allows Tevez deal By Martyn Ziegler Published: 31 July 2007 West Ham could emerge from the Carlos Tevez affair several million pounds to the good if the Premier League and the striker's advisers agree to a deal for an out-of-court-settlement put forward by the club's lawyers. Tevez's representatives, Media Sports Investment, are suing West Ham for £30m for breach of contract after they terminated third-party agreements regarding the player in April. However, it would suit all parties if a deal could be reached, as a High Court case could take months to be heard. West Ham's lawyers have put forward a suggestion under which the club would receive a sum of several million pounds in compensation for agreeing to release Tevez's registration. The Premier League has to be satisfied that West Ham are receiving an adequate sum and chairman Sir Dave Richards, chief executive Richard Scudamore and general secretary Mike Foster spent several hours yesterday discussing the proposal. The league must demonstrate to the other 19 clubs that it is operating under the scenario that Tevez is contracted to West Ham and that the club are not governed by the original third-party agreements that caused West Ham to be fined £5.5m in April. The original contracts only contained agreements for West Ham to be paid £100,000 if Tevez moved on, but if the striker's agent, Kia Joorabchian, agrees to the settlement the Hammers could receive around half the amount they were fined. The Hammers are set to make a move for Eidur Gudjohnsen, meanwhile, after the Barcelona forward said he would be interested in going to Upton Park. The Iceland international failed to secure a regular place last season and Thierry Henry's arrival is set to push him down the pecking order.
Joorabchian insists he will only pay the £100k stated in the contract. Court it is, unless someone has a sudden change of heart. The last option anyone wanted, particularly Tevez as this impacts on his season, but West Ham and the Premiership have left no other viable option. It is also claimed that Joorabchian will be looking for costs and damages from West Ham over the entire mess.
That's another very bias viewpoint Teso. From what I have read West Ham are the only party to have taken steps to avoid court action.
I hope it goes to court, I really do. Teso, if you think that KIA won't budge, then you are crazier than I thought. Of course he will. Also he can only ask for costs if he wins. If he loses, he loses everything. A 30 mill asset and costs. You're joking mate, he will never take the chance. Eggy will win this.
Actually he and MSI has a ten-year deal with Tevez until 2014 so he wont lose Tevez . He owns his economic rights and therefore Tevez is bound to Kia. Personally Kia will get the majority of the transfer fee and WH less than 6 million. So I think you are a bit deluded NT.
I bet also that Tevez will not testify against KJ and will say that it is his signature..many believe that KJ will win the injunction and for the player it would be better that he did otherwise he is limbo because he will not play for WH again.
Well I believe he and KJ both get money from the deal although Tevez will get paid wages by United..KJ gets the transfer fee.
all footballers get 10% minimum of their transfer fee. thats why players move around so much.a prime example is steve claridge, every time he built up debts from gambling he would move to another club and pay of those debts with his 10%. although tevez would be on a loan i'm sure he would get a lump sum.
Kia is a smart businessman, saying that so is The Eggmeister. Kia thinks he can win outright, Egg thinks he can get a large payout from this mess and is relying on the Premier League for this. Kia is relying on contractual law. It seems unlikely that Kia handed Tevez on a plate to WH when they "ripped up" the 3rd party agreement. I don't see why WH are holding out for cash from this. They got the player for little money and he paid them back by keeping them in the PL which is worth more than any tranfer fee they would gain for him. And it's clear he wants to move. The premier leaugue "player registration" stance is all good within premier league law but in common law Kia's contractual rights with Tevez will obviously hold up in my opinion. WH are wasting their time for a few million squid? But whichever way it goes, there are probably going to be appeals going on deep into the season. I can see this getting even messier and dragging attention away from what we really should be watching - football
anyone who loves football would love it to be that way.but in a realistic buisness world that football now is, it can't be that simple. i think as kia thought he was buying west ham, he did give us tevez on a plate.the seperate agreement to be able to sell tevez at anytime was his get out clause,as that was made void by order of the pl he's screwed up. west ham would "give him up" if it was that simple, there must be a reason why they have dragged this out and we will find out why if it comes to court.
The reason why West Ham are keeping themselves involved in this is not for the money. The PL have literally told West Ham that if Kia governs the transfer of Tevez (instead of West Ham) then he is wielding his third party influence over West Ham and therefore the 'torn up' agreement must still exist. If it still exists Sheff Utd will win compensation, Tevez will sail to ManU overnight, Kia will get all the transfer money and West Ham will get £100k off Kia and another whopping great fine from the PL. This just leaves the fans and the press to spit on us while we are down again and demand more punishment. Hence why the PL have been repeatedly saying that ManU need to talk with West Ham. This and the fact that West Ham hold his registration. But ManU haven't even bothered to pick up the phone over the last two and a half months.
West Ham have nothing to fear from that two bob individual, all along Eggert has shown himself to be an extremely shrewd and intelligent man. Whilst Kia, Tevez, Gill and Ferguson have been sounding off in the press we have kept our council. West Ham fans have been reading complete BS and empty sensationalist threats from Kia and Sheffield United etc for months and months. We've seen and read it all before. Manchester United fans on this thread mught be getting excited and taking Kia's words as gospel truth. We know better than that. Thank goodness he didn't get his hands on our club. West Ham don't need the money either, it's not us who have a multi hundred million pound debt.
The authenticity of his signature is not in question. It's the timing of the signature and that can be proved by foreinsics. Funny how it seems to be OK if a player lies in court as long as it suits Manchester United.
You should be ashamed of yourself saying that. What they will want next, is to opt out of playing for the EPL title. The title will be theirs by right and everyone else will play for 2nd place, with Sir Jock having the casting vote.
What a lot of you are forgetting, is that the MSI-Tevez contract is probably illegal. You cannot own economic rights of an individual. It smacks of slavery and is certainly restrictive. I think Eggy wants his 5.5 mill back. I don't think he wants to cheat anyone, but I stick to the point that Kia has too much to lose and too little to gain in court.
I've always had a suspicion that we'd end up with that 5.5mil back. Let's hope so - just want it over really. Are there any parallel examples of someones economic rights being owned by someone else for 10 years Tony? That's pretty much the best part of Carlitos' career.
I thought there was FIFA restrictions on time a player could sign for a club or in this dodgy case, person. Something about under twenty-four you could leave by tribunal and stuff like that????? I'm starting to think Tevez is not an innocent party in all this, it strikes me that KJ came up with the idea and has promised Tevez, probably, half of all transfer fees he will generate over his carreer. By signing year by year deals for tons of cash they will both make alot more than any footballer could just from wages alone. A fantastic business stratagy.......... if only those bastard rule things stopped getting in the way.
NOH, you may be right about the money thing, but I believe that Tevez cares more about the football than the money. That's why his commitment to the cause stood out so much from our bunch of prima donnas last season. That and the fact that he knew ManU were watching!! Consequently now the opportunity to play for ManU has arrived he will be happy to gradually cut his ties with Kia and Co and become ManU's property. I still maintian that there will be another sting in the tail for both Liverpool and ManU once this Tevez business is over. When the time comes for them to try and own the player outright we may well see all this kick off again, because neither club has struck up a deal with Kia to completely own the player from day one.
These are from fans whose club 'acquired' two Argentian internationals in a rather dubious way and did not really care about how you got them. I also think you would not have batted an eyelid if Joorabchian had succeeded in his takeover despite his shady character and background. BTW If you are trying to refer to the FA cup with your 'opting out' reference that was the fault of the FA who wished united to do so and left united to get the stick.
Both our clubs are guilty of dealing with this guy so that isnt much of a counter argument. The main difference with the two deals will probably be that the full details of the ManU/Tevez contract(s) won't be aired in public for all to see. So we will never know just how comparable they will be with West Ham's.
West Ham aquired both players from the man who was in negotiations to buy the club, people from other clubs and the tabloids conveniently like to forget that rather important fact when saying why did they go to West Ham. In the circumstances it would have been strange if they had gone elsewhere. As it happened Kia yet again was found wanting, just as he was the year before when he tried to buy West Ham previously, and in stepped the Icelandic people. They were then left to pick up the pieces of the Brown/Kia debacle and have had their reputation tarnished by every internet loudmouth and tabloid journalist going. The latest reports are that an out of court settlement has been reached. I hope Manchester United enjoy having Kia hanging around their club for a couple of years while Tevez is initially on loan. Two parties made for each other
Looks like it's all over. http://www.eufootball.biz/Legal/030807-West-Ham-Tevez-Kia-Joorabchian-settlement.html
