The league was started as a project by current CONCACAF president Victor Montagliani who's a Canadian. He did so after Canada was eliminated from 2014 Brazil when he was elected as Canada Soccer Association president. He wasn't a fan of MLS when he led the CSA. He even threatened MLS from striping them of the CSA sanctioning allowing them to operate in Canada if the league didn't change it's roster rules that discriminated against Canadians. A few things to understand about MLS in Canada The 3 Canadians clubs are in MLS because they are using a FIFA article stating that only under exceptional circumstances, a club may compete in another country's league. Since there was domestic leagues in Canada, USSF expanded their presence in Canada using that clause. The 3 Canadian clubs needs the sanctioning of FIFA, CONCACAF, USSF & CSA to allow them to compete in MLS. If the CSA, CONCACAF or FIFA says no, the 3 clubs cannot compete in MLS Montagliani problem with MLS was that Americans are considered "domestics". Canadians are "domestics" only on Canadian clubs. On USA clubs, Canadians counts as "Internationals" despite the league operating in Canada. As you can see, it was a blatant discrimination against Canadian players for years limiting their opportunities in the league. Montagliani reacted and threatened to "desanction" MLS Canada and started to work towards Canada's Division 1 league, Canadian Premier League. MLS caved and changed some of their rules by counting Canadian players from MLS academies as "domestics". Americans on this board use the law as an excuse but they can somehow amend roster rules when you press them...NASL & USL have been counting Canadians as "domestics" the entire time. MLS in Canada was supposed to help the Canadian program (that's shame on us). But we ended up stalling and regressing. Montagliani had enough As CONCACAF president, Montagliani made the push to force Ottawa Fury out of USL due to CPL existing. CONCACAF no longer recognize the "exceptional clause" in thei case. All Ontario PDL teams were pulled and forced to joined League 1 Ontario (D3) To answer your question, CONCACAF and the CSA have the power to desanction MLS from Canada. However, the approach is to have CPL grow to the point that it makes business sense for the 3 teams to join which I think wont happen until after the 2026 World Cup.
