Over on the Volokh Conspiracy, they've been reporting for the last week that AGAG's resignation was imminent and that Chertoff is the most likely replacement.
Why would Bush even bother with a recess appointment? Its not like Congress has yet shown any ability to stand up to the Prez.
Maybe in matters of legislation, where they can't override his veto, but appointments are another issue. The Dems could drag the confirmation hearings on indefintely.

Reid and Bush reached an agreement that there'd be no recess appointments this August. It's not a deal that Bush will go back on. I'd expect a former Senator; probably someone close with the Bush 41 administration.
What does Reid get out of the deal? Having Gonzalez resign during recess doesn't sound like much of a bargain for the Dems.
