There should be more cops like Det. Joe Soares of the Newark PD: During the ceremony Detective Joe Soares was named the 2018 Purple Heart Recipient. Soares told TAPInto Newark that he was ecstatic to be given the award and that he had no idea it was coming. "I feel terrific,” said Soares. “It’s a great day.” Soares was shot once in the chest while executing a narcotics search warrant. A police officer for 17 years and member of the SWAT team for 13 years, Soares did not return fire despite the harm that befell him. Soares said there was a child sleeping in a room inside the premises. A humble Soares said he responded exactly the way he was supposed to based on his training and that he simply did his job. Soares said he had good days and bad days since he was shot and that the day it happened seemed like any other up until being shot once in the left side of his chest. If you did what she did, the cops would have shot you when they responded to the call. Then the DA would charge you with second-degree murder, if you were still alive. And then you would be convicted.

The correct charge is murder, and if her defence of mistake flies, then she would either be acquitted or (if the mistake was not reasonable) she would be found guilty of manslaughter I can't understand a charge of manslaughter which pre-determines mistake as to the self defence aspect On a manslaughter charge the only question left is whether the mistake was reasonable, not whether it was genuine. So in other words Defence is putative self defence - i.e. I believed I was acting in self defence but I was mistaken about the actual circumstances Charge of murder: 1. Was belief genuine? If yes - cannot be murder 2. Was belief reasonable? If yes - acquited if no - then manslaughter - i.e culpable homicide via a negligent mistake A charge of manslaughter assumes that she did in fact go to the wrong house That is staggering.
Seems to me the correct charge is murder and the lesser included offense of manslaughter. Then the prosecution has both bases covered in case it turns out against all odds that it was a legitimate mistake. Some states don't allow this, but IIRC Texas does.
I can only reply from general principles but usually a murder charge allows the prosecution to plead manslaughter in the alternative
Yeah, back int he day when I was young and skinny and fit and could run for 90 minutes I used to run the steps of that stadium. Or what is still left of it. The right field Pavilion of Braves Field is still there. At the time the place was built it was the biggest ballpark in the country, holding a massive 45,000 people. It wasn't until Yankee Stadium was built in 1923 (and the Polo Grounds expanded the same year) that it was overtaken.
