It occurs to me that this is a topic that pops up in many threads. Further, I ran across an article on this but couldn't figure out where to put it. Anyway, this is an account of Republicans with a libertarian bent favoring legalization. http://www.motherjones.com/mojo/2013/04/republican-bill-could-end-war-pot-dana-rohrabacher This sounds great, but hasn't the US signed international treaties agreeing to make pot illegal? Would a bill such as be constitutional if, in fact, we do have treaty obligations in the other direction?
OK. But doesn't that take a 2/3 vote in the Senate? Further, as I understand it there's not a separate treaty for pot. And a big part of the treaty is to get gvts. to cooperate against drug smugglers. Now, we COULD lead a movement to just take marijuana out of the treaty and leave in the anti-cocaine, anti-meth stuff.
The blunt answer is yes. “This Court has also repeatedly taken the position that an Act of Congress, which must comply with the Constitution, is on a full parity with a treaty, and that when a statute which is subsequent in time is inconsistent with a treaty, the statute to the extent of conflict renders the treaty null.” Reid v. Covert, 354 U.S. 1, 18 (1957).
Nice.... I have no source ATM (lazy) but IIRC and treaties about drugs: I am pretty sure it was the USA that led that crusade and often coerced signatories under threat of removal of other types of aid. End the madness.
Are you trying to tell me that an 11-year old forum doesn't have a single legalize pot thread before this? I call shenanigans.
It's walked into some libertarian threads, ordered a pizza, and fell asleep before it was delivered. Yeah, there's buds all over it.
What if they have mishandled the weed. I dont mean if they have already smoked/sold/planted it on someone. I mean if they let it dry out so as to be a different product than they confiscated? Will tehy be financially responsible for its degradation and required to pay for its replacement?
God, being just on the wrong side of a state line...that sucks. Hopefully they get their kids back. Hopefully we legalize pot nationwide. Wouldn't that be a hoot - the Roberts Court legalizes marijuana.
Friggin redneck cops in IDAHO who woulda thunk it? I checked though and Idaho is not a MMJ state. Pretty stupid to leave the stash laying around when the babysitter is in the house, especially considering they were activists. It isn't legal where they live so it was pretty dumb on their part. Note: in no way do I support law enforcement's effort at marijuana prosecution of adults that do not involve contributing to delinquency of minors.
