That's not a strong burden argument. I expect the Court will order USSF to produce at least some of this material. The burden can be produced by more narrowly-tailored document custodian identification and key-word searches.
Yeah.. I suspect that USSF is more arguing that they shouldn't have to look for information from prior to NASL's existence.
Pre-claim course of dealing is often relevant in antitrust to show a continuous course of conduct although here it is a bit more tenuous considering NASL did not exist yet.

So the remaining NASL teams started this whole poop storm because they were insulted about being given the 3rd Division label, only to start a new league that at best will be given the 3rd Division label. Somebody has to save these independent soccer clubs from themselves.
I am assuming it is in regards to the fact that USL announced a new team in Chattanooga that isn't tied in any ways to the already existing NPSL team. It pissed off the current team and likely others in the NPSL looking to start a pro team.
Like alcoholism and other problems, the independent clubs have to want to be helped. USSF tried almost a decade ago - with the help of the then minor league pro clubs. It actually pretty much worked. But some of the newer investors apparently have decided to forego learning from the experience of their elders and insist on learning things the hard way.
Seeing some chatter on twitter and reddit the NASL teams (probably just the Cosmos) are hoping to keep this league amateur. Something about it’d help their lawsuit because if it went pro they’d look like hypocrites. Sounds like a conspiracy theory to me, but with NASL you never know.
