The question is, does this help Wynalda politically, or hurt him? I think it might actually be the latter.
Could anything actually hurt him? When you have a tiny, insane base, you cater to that base and hope for the best.
It's now more than a month since the oral arguments before the Second Circuit--a pretty long time for the court to issue a ruling in a matter involving a request for a preliminary injunction--even with the holidays. Preliminary injunctions, after all, are meant to preserve the parties in a situation such that the court can grant effective relief at the end of the case. It's doubtful that a decision in favor of the NASL at this point could accomplish that, given the changing facts on the ground. Each day that passes strengthens my impression that the court is likely to side with USSF, while issuing an opinion that clarifies the legal grounds for granting a preliminary injunction (a subject on which there is significant disagreement among courts).
As of a week ago, the court hadn't issued rulings on any of the cases that came before them that day (maybe even that week?).
NASL’s attorneys are probably telling them the same, hence the rest of the league is looking at ways to jump ship.
Like I said, appeals involving preliminary injunctions generally have a special urgency to them; they are usually decided more quickly than other matters--at least if the court is inclined to grant the injunction. (I once worked for a judge on the Second Circuit, and I now teach this stuff).
------- Well if the issue between USSF and NASL was heavily about NASL not meeting the standards, then it better apply fairly to USL 2 & 3. Don't get me wrong, size of league doesn't dictate the number of games, it just however many teams are going to be in whatever level, they need to meet the requirements, right ? Having several levels I believe in the long run will allow a team to find its right level. In turn, the more stable the teams are, the more stable the league will be.

Try telling that to my Chinese colleague who was denied entry back into the country for weeks for no explained reason, or our Muslim students who couldn't leave the country for fear they wouldn't be allowed back in. Yes, China is the #1 beneficiary of the Trump presidency. But that's not good for us. And yes, Israel is happy, but that's not the Middle East (just one country in it).
