Aside from designated players (DPs), it would seem that every other player in the league has a contract which does constitute third party ownership even if the administration of the league doesn't fit the bill of typical third party owners.

I'm not sure if the practice should be done away with, but in the event FIFA were to put forth compliance orders banning the practice, complications would most likely arise for the MLS and I suspect some kind of work around solution would be needed until the practice could be completely phased out.

No MLS LLC legally owns all the teams and all the player contracts.

So they are not a 3rd party.
