No. Shooting someone is not the same as conducting war against a government, and what "Enemy" was being given Aid and Comfort? No, this would be (potentially) mass murder, that's all.
With gunsights? Look, I have no idea if that is common or not. Maybe Nancy Pelosi and Harry Reid's PAC committees put gunsights on political targets. But ... if you have your name attached to a site that puts a gunsight on a politician who is assassinated, effing hell that's bad. Whether it's Palin or Pelosi or Reid. This country never ceases to surprise me, but I just can't see how a politician could ever live that down.

I didn't say everybody does it. The attacking of a Congressperson is very very rare (thankfully). I don't think that only one side (as if there are only two anyway) is capable of it. Again, we don't know anything about the shooter(s) other than that a Congressperson was among 12(?) shot at an event she was holding.
Right. As long as the emphasis on "speculate" of course. When you mention evidence, we are at this point talking about the type of circumstantial evidence that is only relevant in the sense that it might reasonably lead one to speculate that this could be a possibility. That's all.
But who declared "War"? A single person or even a small group can't declare war. The person(s) who did this will be facing life in prison, if not death, if identified and caught. That seems like enough of a punishment for me.
