    Americans being online dicks about a topic like this (or not considering it a topic that deserves better than dickishness) is part of the America I'm referring to along with the earnestly conservative posters on the given link.

    Of course, this is the Internet and not all those dickish posters are American, so there's that.

    Not a lawyer, so maybe they can.

    In any case, I can't imagine a judge appointing a Jewish lawyer and an Indian lawyer to represent this defendant. Maybe it's a list --next man up, or something-- but I'd sure try to accommodate the defendant's assumed wishes in advance. Just find him a White lawyer up front and assure the lawyer he won't be blamed for doing his best.

    This is the kind of bureaucracy that would make me take my name off the list. I'm not going to defend this man for money, sure as shit wouldn't do it for free.

    Just an FYI. Looking at the tuition costs of Transy (35K) and where this guy is from (Harlan County...poor even by Ky standards) it's a safe bet this guy had scholarships or came from money.

    It is part of the process of getting certified to practice before a court, isn't it? And it seems to me that I've read something to the effect that judges keep a rough tally of the load that each lawyer is carrying and tries to hit the guys without so much on their plate? Though I don't think it is the same in all venues.

    And I don't see any reason why the ethnicity of the lawyers should be a consideration for the court simply because of Roof's preferences-- the responsibility of the court is to see that he is competently represented, not to cater to his prejudices. If these guys are up next, or not busy, or whatever, he gets them.

    But it has been a long time since fifth grade civics... maybe somebody else here actually knows...

    Well, I suppose it could be argued they're quite clearly not representative of any given community, by definition, because the vast majority of people DON'T comment on published articles, do they. They're an incredibly small subset of a much larger group.

    It's a bit like the old advert about, '8 out of ten people who expressed a preference...'. Not the same thing, is it.

    Whether the much larger group is better or worse, that's another matter.

    Isn't the point about lawyers that they don't 'defend' the plaintiff, they 'represent' them.

    I understand it may be considered a conceit but it's an important point IMO. So it's reasonable to represent someone regardless of who they are so justice can be seen to be done. In that way we prove we're better than murderers like that arsehole.

    Man U's blackness this season is certainly being noticed. I've read several comments and jokes already.

    The fact that they're doing great is certainly keeping most of the abuse at bay so far. Just gotta wait until they hit a bad stretch for the real gems to come out.

    This isn't a typical case- it's a hate crime. He doesn't want them to defend him (he's a defendant, that's all I meant) in the same way he didn't want his victims to live. The lawyers would probably pass, given the chance. I see no problem reassigning.

    I'm surprised nobody with real legal training has been here yet to help us out.

    I cannot comment about South Carolina, but Judges generally can appoint counsel and counsel has to come up with a pretty compelling reason to refuse. It happens way more frequently in smaller or rural jurisdictions, but I have been "appointed" in Cook County, IL a few times, particularly for elderly clients. However, since I work in legal aid (specifically representing low income seniors and people with disabilities), that is not a surprise. We have had a couple of recent situations where the senior would not even qualify for our services, but if the judge appoints us, we will serve.

    I have also been asked to stay in court after I have withdrawn from cases as an "officer of the court"...in case the judge has questions about the case from which I had just withdrawn.

    Finally, the ethnicity of the lawyer should have NO bearing whatsoever on whether or not that lawyer should be appointed. I think if the judge decided to pick and choose the lawyer based on ethnicity, that would be a major problem.

    Wow. I checked the Prem table two days ago, but that was the first time I'd looked for anything related to other leagues* so I'm just now hearing about this... Googled the lyrics

    Part of me is like, "Yeah, that's gotta go..." and the other part is convulsing on the floor in laughter. I'm not sure I can get too worked up about that one, other than it might lead to much worse stuff if the bolded happens.

    *Man, having a top-flight team so close is totally new to me and it's taken up most of my footballing time. Now that I have AUFC/MLS, I get what that guy in the Fight Against Modern Football thread is talking about. I couldn't care less right now about how the big clubs are doing ATM. I'll check in on everything else soon enough, but having a dog in the fight just matters a lot more, even if it's a small dog in a small fight.

    No, this is not the case at all.
    There is really no "certification" to practice before a state court.
    In most states, one graduates from law school, passes the Bar Exam, passes the Multi-state Professional Responsibility Exam (ethics exam) and passes a "character and fitness" review and then is sworn in to the practice of law (usually sworn in by the Supreme Court of the state).
    Once that happens, one is allowed to practice in any state court in that state.

    I am licensed in Illinois and have practiced in about 6 or 7 different counties.

    There is a requirement in federal court that one is sponsored (even though I have 15 years of practice, I had to be sponsored this year, as I had not practiced in federal court previously).

    This might happen in really, really rural jurisdictions, but not in a major locale at all.

    Domingo Soto, a Mobile-based civil rights attorney who is Hispanic, said the girl comes from a family of Democrat Bernie Sanders supporters, and that Friday's pep rally has become a "teachable moment" for her on issues of white privilege and the Deferred Action for Childhood Arrivals (DACA) policy. Soto is the family's attorney.

    Yeah, I notice she is White. Just because she is a Sanders supporter, or her parents are, doesn't mean they are not racist.

    "When I first saw it, my reaction was 'I'm very angry. I'm Hispanic and a civil rights guy,'" said Soto. "But she's mortified by it. It wasn't her intention to mean anything harmful by it. It was insensitive on her part because she didn't think about it. I'm amazed at where this has gone."

    Of course she is. She never considered that her White "taunt" could be taken in a racist way. How White privilege of her.

    And as for Soto's line about being amazed...huh? Has he not been on the internet the past several years?

    The girl was pictured in the now-viral photo holding a sign which she made that reads, "Put the Panic Back in Hispanic." Standing next to her is another girl who is holding a President Donald Trump "Make America Great Again" campaign sign. Also in the picture is the Robertsdale High School mascot.

    Soto said the girl never intended to bring the sign into the school's gymnasium, where the pep rally was held. He said the picture was snapped at the end of the pep rally, and was the result of a confluence of accidental occurrences.

    The girl, he said, had left the sign in a truck of a friend who had also brought a host of items to the pep rally, such as balloons and confetti.

    He said the Trump banner was brought into the gym by an unknown student as part of the junior class's "patriotic" pep rally theme.

    "For some reason, someone thought that since he's the president, the banner should be there," said Soto. "I don't know if the school knew the banner was there or gave it much thought and it just blew up."

    Again, no. Perhaps this was a setup by a third party, but nobody can be that naive, specially at 16, not knowing that they weren't kosher. And who brings that banner to show patriotism? Did White people bring Obama banners to school to show patriotism? Nope. It is a 45 only thing.

    There is more to this, if you read the article. As I kept reading, though, as a former high school teacher, it keeps feeling like a set up. Apparently neither girl brought want they were holding, and it came together at the last moment. High school students are savvy enough to pull off something like that.

    Two things to note here:

    1 - the wholesome, All-American smile and look of the girl on the left as she casually holds a racist sign at a pep rally.

    2 - you'll inevitably find a Trump sign or MAGA hat at events like this all over 'Merica.

    The massive assholery unleashed by TrumpCo in the past couple of years is astounding and who knows how long it'll last. Why if I was a billionaire I'd be funding antifa groups all over the place.

    Sometimes the kid manages to go stupid on his or her own (or more likely, under the influence of friends) but that's a lot less common than carrying parental stupid into the next generation...

    Tote up all the stupid I did in my high school, and you'd think my parents were complete idiots. And I was a good boy, all things considered.

    Perhaps you're saying this is a different kind of stupid, that hanging around with people brandishing Hispanic-bashing signs is a different and more meaningful level of stupid than getting drunk and driving dad's car into the curb (raises hand), or getting stoned and driving on the sidewalk at 2 AM (raises hand). I don't know, maybe.
