Just like Ottawa can't be forced in CPL, CPL can't be forced to take MLS2 clubs. Officially, this is about enforcing existing rules, which I admit, leaves little options but to join CPL. However, CPL is under no obligations to accept OSEG as owners either. Fury could be forced to sell or fold
Well, considering, that they'd 1) have to cut their player budget and 2) release their Montreal Impact players and 3) leave their stable home for a league that has yet to play a single game while 4) TF2 is being ignored, I'd consider those to be pretty exceptional circumstances. While #3 will no longer be valid in a year's time, the CPL Fury would not be the USL Fury in anything other than intellectual property and operations/technical staff. I'm not saying they'd win, but they'd certainly have a case. And I think everyone else but you sees that as CONCACAF has suddenly reversed course and said they're cool with Ottawa playing in the USL this year. We'll see what the CPL looks like next winter.
How can FIFA block it? On what grounds? All the Fury has to do is declare a bias and what are FIFA going to do if they defy their order? I don't know Canadian laws but I doubt they will show up in court.
Desanctioning is what they risk by going rogue. Not sure that's what you mean. The CAS is their only option. This has no place in Canadian courts
In a US Supreme Court, I've seen FIFA lose on greater issues. I think if the Fury really wanted to fight it, they could taking it to an international court and I can't see how they could lose.
Well, they are playing 2019 and CPL would have had 1 year under it's belt. They already cleared their roster, I mean they gutted it. TFC II has no place to play. Division II does not exist and TFC III plays in League 1 Ontario Not sure many would lose sleep over the name "Fury". Unlikely they would keep the name. Besides, far from guaranteed that CPL wants them after this fall. Their case is weak in my opinion. Obviously, CONCACAF are not cool with the Fury in USL but that wasn't worth going to CAS over. Next year issue, if the Fury keeps it up, will go to the CAS.
Fury are based in Ottawa and Canadian laws are different... No way in hell this goes to our supreme court. They'd be desanction in the meantime, which doesn't improve their situation
I can virtually guarantee that is not how it would work. Being forced to sell, or go out of business, easily meets the “exceptional circumstances” threshold.. If Ottawa is told they can’t play in USL because of the CPL, then CPL would have no choice but take them. If CPL refuses, Ottawa would just go back to CAS and say the CPL is forcing them out of business and CAS’s response would be either to force CPL to take them, or allow Ottawa to play in USL..
That's an interesting point. I wouldn't agree that CPL is forcing them out of business but they sure better repair those burn bridges
This whole thing is such a cluster. USL/ USSF-CSF/CPL-CONCACAF/ FIFA. I am a citizen of both countries and badly want soccer to succeed in both, but especially in Canada as its fallen behind where they should be. Soccer should easily be the #2 sport behind hockey. -As much as I am not much of a CONCACAF or FIFA fan, I kind of wish they would put the hammer down and tell all teams (including the 3 MLS teams) they need to play in CANADIAN based leagues. After that, it will become strictly the how well the Canadian Federation and Canadian leagues do in managing the game, sink or swim. -My selfish part then says, MLS would be able to add 3 more USA based teams and if MLS goes to 32, that would truly cover all markets that are being rumored to want teams. - -My ultimate question is, how do you move the 3 MLS teams to CPL? What are the legal, financial, organizational issues for this to happen ? Are there any studies or reports out there done by anyone on this matter? How much did these 3 teams each pay for expansion fees? How do you factor in all the money they have spent so far ? (or do you) Are they required to pay players in US dollars now or Canadian? If they move to CPL, then Canadian $ ---

Ultimately, must be their choice or lack of choice via desanctioning They will qualify as fitting the "Exceptional clause" under FIFA convention allowing them to play in MLS as they predate CPL. I doubt it TFC paid $10M. Vancouver and Montreal paid $35M each Hard to say but tons is reasonable US dollars.
With the rising expansion costs, I'd say TFC, Vancouver and Montreal got in at a bargain. I recall not that long ago how Joey Saputo was complaining of not wanting to pay the hefty MLS entrance fee or at least saying how high it was. I think AEG also made a killing as well by inheriting the Quakes for even less than what TFC paid. Compared to now where the expansions fees are over $200 million, I'd say they all got away with a pretty good deal. That's actually smart of them to come in when they did. Aside TFC, the Impact and Caps aren't even more than 9 years old.....

================== So, a wealthy Canadian Billionaire comes along and wants to buy theVancouver Whitecaps and then move them to the CPL. He likes the idea of CPL as he would have rivals in Victoria, Edmonton, Calgary etc. He could structure his budget on the Canadian dollar, not the American dollar. (Don't worry, he would still play Seattle and Portland in a Cascadia series ) If he could pay MLS/current team owners an agreed upon figure, would he have the right to then move the team to the CPL?
Because Canada is a valuable market for MLS and decreasing their presence there would be a bad thing..
Why doesn't this Rich Billionaire just start his own team and join the CPL? Forget about the Whitecaps..
