I reckon he was nominally a member of another Italian club. Serie B clubs have no restriction on signing a non-rule player within Italy.
You are perfectly right, that could be one possible "escape route". I've read the rules (and I mean i've read the official documents plenty of times) and they do not make it clear if what you say applies to a player that has been contractless. They literally just say you can't [blabla] non-UE player "coming from abroad". Which makes me think you are right.
