Apparently, the Arbitration panel won't make any decision 'until the end of the month or maybe sooner', according to the BBC Sports site.
They're going to evaluate all the evidence etc, but the panel doesn't have the authority to actually impose any penalties. It can only recommend to the League various alternatives, such as a new hearing.
I don't know if this is a good or bad sign; I'd rather have had a quick decision, but this delay implies that there could be complicated issues, rather than cut and dried ones. Regardless, it still seems to me that the League has the final word and the ultimate authority to levy whatever penalties it wants, and it did so originally. I can't believe they would want to change the status quo, which would result in an immediate and massive law suit by the Hammers.

They are just erring on the side of caution this time,to make absolutely certain that there can be no challenges.
BTW who were the 3 sides mentioned in the report.I thought it was just sheff utd and the PL.

The three sides that were heard were Sheff. Utd., The PL and Mr Parry, who helped make the rule book and pointed out the offence in the first place.

My bruv, the judge, said: '.They already know the verdict, well they are no more than a couple of G and Ts away from it. They just need time to write out a 3000 word summing up, giving their reasons for coming out in favour of the PL.' He also said that if they did say that the panel should sit again: and they won't; the PL would not let them, because West Ham would have a cast iron case in a court of law, that they had been tried twice for the same offence.

Don't worry. During the coming two weeks, Sheffield will be investigated for the same offence. The story is almost over.

I'm not sure if that is true since wasn't West Ham found guilty? So the issue is only the sentencing or penalty. It's not really double jeopardy since they were never found innocent.

You cannot have a retrial if you plead guilty and accept the sentence. Only the accused can appeal. You cannot be tried twice for the same offence.:D

I wonder if the delay is also due to the Kabba affair. Maybe the PL have influenced the arbitration panel to delay the ruling until the Kabba transfer has been investigated. It would be a bit underhand if they have but to say to McCabe on the day that he has committed the same offense as us and should walk away and shut up would put a rocket up his backside.

I was talking to my ManU mate last night and he made me think about something. If the Howard/Kabba agreements were not documented in the players new contracts then the PL cannot act against them. Our clauses were documented in the players' ownership contracts but the Howard/Kabba deals were a 'gentleman's agreement'. So can the rule U18 be broken if the third party influence is agreed verbally and not contractually?

If the player was still on loan to Everton or Watford respectively then their could be a conflict of interest, i.e. Howard may not try as hard against ManU if he is still on their books. But I don't think this was the case.

I expect they will take the full amount of time allotted, so I don't expect to hear anything before the end of the week.

I also think it's safe to say that we won't sign anyone until it's over.

You have to wonder if the lack of movement on the Tevez front, has anything to do with the lack of a final judgement.

The forecast now is a recommendation by the Arbitration Tribunal will be released on Tuesday; this worries me a bit, because it should never have taken this long for a straightforward decision to be made.
If the recommendation is to uphold the original decision, that could have been said in 24 hours! If there are various other suggestions, that could be dangerous for the Hammers, unless they involve only compensation or some other benefit for Sheff.Utd, for example.
As long as the penalty for West Ham is not changed, it'll be OK. But I won't relax till it's over!

Takes a long while Leslie. First they must go carefully through the arbitration evidence, then they must all be familiar with the original hearing. Lots of dates to check and letters etc.

They also have to meet a few times, reach a verdict, write a 3000 word report: then have that checked, do any altrerations....etc, etc.

You must also remember that they are baristers and will be fairly busy people. Not easy to arrange meetings that suit all of them.

Sheffield United's bid to regain their Premiership status appears to be over after their bid to see West Ham docked points was dismissed.
An arbitration panel upheld the Premier League's decision not to dock the Hammers points over the signings of Carlos Tevez and Javier Mascherano.


Bwahahahahahahahahah.... what a complete waste of everyone's time and someone's money. :D

To be honest, there have been a large number of Blades fans who did not support such action and have had to deal with this nonsense as well as relegation.

For their sake I hope their club does ok next season.
