After all the talk in the last days, DFL held the judgement today: Bayern pays 3 M. 2.5 M go to the league, 500 K to a social organisation, most likely some aid for the population in Iraq.
My reasons why this judgement is a farce and a scandal:
1. Bayern dictated this judgement to DFL with their behaviour in the last days (first they announced consequences for any punishment; then they rowed back and told to accept a low fine).
2. DFL loses any rest of credibility with this judgement.
3. legally the judgement is bullsh!t: either a contract is null and void or it isn't, but never it is "a bit null and void". DFL punished because of moral faults. We got paragraphs against it, declaring that in case of moral faults a contract has to be null and void. Consequently this means full repayment, but not just a bit.
4. Bayern made 18.5 M profit with a void contract. Even Kirch Media owned sport1.de is writing "Punishment" and "18.5 M Profit Punishment"
DFL urgently has to do measures to regain credibility. In my opinions this has to be done:
1. Get all club officials out of all DFL instances. DFL has to be entirely with independent people free of any club interest to administrate the league.
2. There has to be a punishment-catalogue taking all discretionary powers from DFL. When something is violating these rules, the punishment has to be enforced automatically independent of the name of the violator.
3. (independent of this judgement). The meeting that is in analogy to the US League's Board of Owners, has to get rid off the 100% voting system. 100% only works in a dictatorship or in small groups, but never ever in a board with 36 pro teams in different situations. The way it is handled now, it is a mere blocking instance to keep the power for the ones top. This is good for them, but extremely bad for the sports and the league - the system has to be changed to either 2/3, 3/4 or 4/5 majority voting system for changes.
