I am utterly confused. How big a deal is this for someone deciding whether to jump on the Dish boat in the next six months or so?

I think he's referring to last month's awarding of $74 million in damages to Tivo and an injunction (since blocked) preventing Echostar from using Tivo-features in their DVRs.

Don't worry about it.
EchoStar has said that it only refers to part of their DVR software, and in the event of a decision against them, they can replace the DVR software with new software (which they are undoubtedly working on).
So, it is only a financial contest, it won't affect consumers.

I think there's a thread about this, but basically it boils down to if you want a ton of really cool features or if you just wanna record programs, pause live tv, quick rewind, etc.
The uber-cool TIVO features are that: awesome. But the price you pay is $13/month (?) plus the initial unit fee vs. $5/mo and a freeeeee unit; plus... you get 100 hours of recorded programming w/ DISH and 2 TV hook-up vs. 40 for TIVO and one tv hook-up.

Sorry for not making the connection a lil' bit clearer:
No matter how you slice it, the DISH DVR is less sophisticated than TIVO, making it easier for them to go around the legality issues by redesigning the software. From what I understand, there is a connection btw the sophistication level of the devices and copyright infringement.
