Oh God, I'm afraid to ask. Is this the "Takings" prop that Oregon passed a couple years ago? Do tell....

Will save analysis for another time and place but for this one thought: If they're proposing direct payments as the means of compensation, I wonder if they've calculated the amount of money local governments will end up paying, how many lawsuits will come about, etc. I was sorry to see Thomas Sowell post a rather uninformed opinion peice about a similar matter several weeks ago.

Regulatory takings....government says your property is full of wetlands so you can only develop half of it...landowner says "Pay me, government."

Picked up The Curse of the Were Rabbit the other day, an awesome movie. Bonus disc included a series of short clips, including one called The Soccamatic. Or as Wallace officially called it, the "Preston North End Soccamatic 5000: All the goals and none of the fuss!" Hilarious clip, especially at the end.

Edited after realizing I referred to an animatic film as "feckin awesome!" :p

OK..veering awfully close to politics here, and I'll shuffle off to the politics forum for a proper brawl over it, buuuuuut....

I don't know how they can say that this rebuts the Kelo case. I live in New London county so I know plenty about it....they are paying landowners for that taking. The question in Kelo was about whether economic development was the proper use of eminent domain...Oregon's Prop 37 is about creating a payment scheme to offset regulations.

I can't stand the Journal's opinion page. Makes me ill.

EDIT: Speaking of 1886, I still have all those samples for everyone. I just figured since I'd be seeing everyone in Chicago, I'll just bring them with me then instead of mailing them out. Work okay for everyone?

This particular measure is referred to inverse condemnation, wherein a government action is seen as devaluing a property. I'm a firm beleiver that where restrictions are applied there needs to be compensation, typically in the form of tax relief. Many of these measures, however, are designed for more open ended attacks, including the denial of a rezoning. Here's the problem: If there is a sound scientific basis for the application of a land use regulation (protection of water resource, lack of proper infrastructure...) then there shouldn't be anything left open for debate, or to justify that said action is causing undue harm to the property owner.

Many local governments have brought this on themselves, sadly. I know around here many councils base their decisions on political will rather than net impacts. We're working to change that, but this backlash against the worst of land use management measures could inadvertantly swing the pendulum too far back to a position of leaving the local governments inable to do anything.

Okay, now seriously, I'm done.

his album comes out in april...it's good. he's playing in the atl on Aprl 25....definitely worth checking out.
