I just sent a note to Ebay! reporting the seller. If he's based in California, and is effectively selling chances to buy a ticket (like a raffle), both the seller and Ebay! could be in violation of state Gaming Provisions, specifically California Penal Code Sec.319, 321, and/or 322:

But it is not illegal if he faxes it in.

Wouldn't this end up being under Federal or international purview rather than California's? (I'm asking, not saying. I'm curious now)

I'm not a lawyer, so I'm not sure whose purview this would be under, but this is certainly something Ebay would want to explore.

Me trying to provide humor to myself. Sorry.
I figured everything with faxes is perfect and legal.

I actually found those auctions last night.

I wrote both the auctioneer and the high bidder.

To the seller I asked - How are you so sure you will get tickets?

And to the bidder I basically explained the process of the USSF pre-sale, about how he has no guarantee of receiving tickets. I'm not sayin, but I'm sayin, that there hasn't been any more bidders. Lets hope not.

I just got a response from the seller:

he says "I will know in a couple of weeks"

FYI - I sent this to US Soccer yesterday:

Name: Mike Lastort

E-mail From: lastort@comcast.net

Feedback:
I wanted to make sure you are aware of the fact that some people are attempting to sell passwords that were sent out yesterday. I hope you will take appropriate action against the people who are doing this.

See the following thread on BigSoccer

And these items for sale on EBay

Thank you for your attention.

This is the reply I received:

Hi Mike,

Thank you for bringing this matter to our attention! Tickets order forms not containing both the registered ussoccerfan.com e-mail AND the corresponding password will be considered invalid and therefore will not processed by U.S. Soccer. In addition, any order forms received at U.S. Soccer containing passwords that have been seen posted for sale will not be processed. Any registered ussoccerfan.com members whose passwords are found to be "sold," will immediately lose their ussoccerfan.com membership status and the opportunity to participate in the ussoccerfan.com 2006 FIFA World Cup ticket pre-sale.

Thank you again! And thank you for your support of U.S. Soccer!

U.S. Soccer

Hopefully, the fed is taking care of this.

I emailed that to the bidder. But that would be my 3rd message without a response so far.

Check his items for sale. The bidder looks like a ticket broker.

So who wants to offer up their eBay ID for sacrifice, bid this auction to $1500 and not pay?

I'd love to but I have 276 feedback score, 100% positive....

What, when he gets a knock on his door from the local police?
